THE NATIONAL GOVERNMENT THROUGH THE MINISTRY OF AGRICULTURE, LIVESTOCK AND FISHERIES AND THE COUNTY GOVERNMENT OF MIGORI FOR THE 217 THE KENYA GAZETTE 13th October, 2023 4554 4554 MANAGEMENT OF ALL FINANCIAL RESOURCES OF AGRICULTURAL SECTOR DEVELOPMENT SUPPORT PROGRAMME PHASE II (ASDSP II 2017-2022) MEMORANDUM OF UNDERSTANDING (MOU) THIS Memorandum of Understanding (hereinafter called the “MOU”) is made this day of the month of 20 between the National Government through Ministry of Agriculture, Livestock and Fisheries, State Department of Agriculture having its principal place of business at Kilimo House, P.O. Box 30028–00100, Nairobi (hereinafter referred to as the “National Government” which expression shall where the context so admits include its successors and assignees) on the one hand and The County Government of Migori having its respective principal place of business and address within Migori County and for purposes of this MOU its address is through the Council of Governors P.O BOX 40401–00100, Delta House, Nairobi (herein after referred to as “County Government”) on the second part; (hereinafter both the National and County Government referred to collectively as the “Parties” and individually as “Part'/'). WHEREAS (a) The National Government through the Ministry of Agriculture, Livestock and Fisheries and the County Governments through the Council of Governors have developed a Programme proposal known as Agricultural Sector Development Support Programme Phase Il (ASDSP Il) following the expiry of ASDSP I. (b) The Proposal has been submitted to Government of Sweden (GOS) for support through the National Treasury and the proposal has been accepted by GOS who has committed to grant Government of Kenya (GOK) Three Billion, Six Hundred Million Kenya Shillings (3.6 BKES) for five years. (c) The National Government and County Governments have agreed to co-finance the ASDSP Il Programme by contributing Kenya Shillings eight hundred million (800,000,000 KES) and one billion, two hundred and ninety two million, five hundred thousand (1,292,500,000 KES) respectively for five years. NOW THEREFORE, the Parties hereby agree and acknowledge as follows; I. Objectives of the MOU The objective and purpose of this MOU is to establish a structured framework for collaborative partnership between the Parties for the management of all financial resources committed for the implementation of ASDSP ll. II. Obligations of the Parties (a) Common Obligations 1. The Parties will be fully responsible for the implementation of the programme and for the management of all the financial contributions from Sweden and Kenya as per the specifications in the programme document. As a financier, Sweden shall not bear any responsibility and/or liability to any third party with regard to the implementation of the programme. 2. To ensure smooth implementation of the programme, The Parties will provide the required counterpart funding as provided and agreed upon in the financing agreement. 3. Whereas (GOS)has agreed to align its financial obligations with Kenya's budgetary cycle, The Parties too, will ensure predictability of their financing obligation through timely disbursements and cash floor management 4. The Parties undertake to: (a) Maintain accounting records that are accurate and reliable for information and decision-making. (b) Ensure effective control and efficient utilization of the programme funds. (c) Provide reports to development partners, external auditors and other stakeholders in accordance with agreed formats and reporting periods. (d) Ensure preparation and effective implementation of budgets that support the objectives of the programme implementing levels and development partners. The Committee may from time to time, with the approval of the Cabinet Secretary responsible for Agriculture, Livestock and Fisheries, co-opt other members whose competences and experience it considers necessary for the performance of its functions. 3. The Terms of Reference of the Technical Team are to— (a) review, identify and prioritize recommendations contained in the Miraa Taskforce Report for immediate - implementation; (b) provide technical guidance and facilitation in the implementation of the Reforms and ensure that such implementation is consistent with Government policy objectives; (c) develop a detailed implementation plan in line with the Report of the Taskforce on development of the Miraa Industry; (d) develop a road map and action plan for the development of the miraa sub-sector focusing on production, value addition and marketing; (e) review the current regulatory framework for the sector and propose changes to align it to current and future needs; and (f) prepare and submit to the Cabinet Secretary quarterly status report on miraa sub-sector reforms. 4. In the performance of its functions, the Committee shall be responsible to the Cabinet Secretary for Agriculture, Livestock and Fisheries. 5. The Committee shall remain in office-for a period of twelve (12) months or for such longer period as the Cabinet Secretary for Agriculture, Livestock and Fisheries may, by notice in the Gazette, prescribe. 6. Secretariat The Secretariat of the Technical team shall be provided by the Ministry of Agriculture, Livestock and Fisheries. Dated the 31st October, 2019. Terms of Reference of the Taskforce are to— (i) review and evaluate in comprehensive terms, the weaknesses and shortcomings of the entire Standards and Quality Infrastructure institutional architecture and arrangements in the context of executing the broad mandate and define and recommend an effective, robust, internally coherent and agile institutional architecture in accordance with international best practices in progressive jurisdictions and in conformance with the WTO-TBT obligations; (ii) analyze the entire ecosystem policy, legal and legislative frameworks of the various institutions/agencies and make appropriate recommendations to re-engineer the Standards and Quality infrastructure architecture that is effective, robust, internally coherent and agile with better-connected institutional arrangements to meet the country's goals of managing and mitigating risks to quality, health, safety, environment, fair trade practices, and consumer protection among others; (iii) analyze and map the roles, objectives, functions and operational scopes of various institutions/agencies involved in the entire Standards and Quality infrastructure ecosystem, and make recommendations on reforms to eliminate conflicts of interests, overlapping, duplicative and sub-optimal practices that negatively impacts the efficient enforcement of standards, regulations
