GAZETTE NOTICE NO. 2717

IN EXERCISE of the powers conferred by section 152 (3) as read with section 65 of the Water Act, 2016, the Cabinet Secretary for Water and Sanitation and Irrigation determines as follows — (a) THAT the persons specified in Part A of the Schedule hereto, who were employees of Athi Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Athi Water Works Development Agency on the same terms and conditions of service; (b) THAT the persons specified in Part B of the Schedule hereto, who were employees of Tana Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Tana Water Works Development Agency on the same terms and conditions of service; (c) THAT the persons specified in Part C of the Schedule hereto, who were employees of Tanathi Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Tanathi Water Works Development Agency on the same terms and conditions of service; (d) THAT the persons specified in Part D of the Schedule hereto, who were employees of Coast Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Coast Water Works Development Agency on the same terms and conditions of service; 19th March, 2021 (e) THAT the persons specified in Part E of the Schedule hereto, who were employees of Northern Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Northern Water Works Development Agency on the same terms and conditions of service; • (f) THAT the persons specified in Part F of the Schedule hereto, who were employees of Lake Victoria South Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Lake Victoria South Water Works Development Agency on the same terms and conditions of service; (g) THAT the persons specified in Part G of the Schedule hereto, who were employees of Lake Victoria North Water Services Board on 3rd May, 2019 shall, with effect from the same date be deemed to have become employees of Lake Victoria North Water Works Development Agency on the same terms and conditions of service; (h) THAT the persons specified in Part H of the Schedule hereto, who were employees of Rift Valley Water Services Board on 3rd May, 2019 were, with effect from the same date be deemed to have become employees of the Rift Valley Waterworks Development Agency on the same terms and conditions of service; AND (i) With regard to this paragraph (h) above, the Cabinet Secretary having exercised powers under section 65(1) of the Water Act through Legal Notice No. 4 of 4th February, 2020 to establish two new Water Works Development Agencies and revoke establishment of the Rift Valley Water Works Development Agency further determines and directs as follows— (i) THAT the persons specified in Part H of the Schedule hereto, and who are now specified in Part I of the Schedule hereto shall, with effect from 4th February, 2020 be deemed to have become employees of the Central Rift Valley Water Works Development Agency; and (ii) The Cabinet Secretary further notifies that decisions concerning the transfer of pensions relating to all employees specified in this Legal Notice and the Schedule hereto shall be determined at a later date through the relevant Legal Notice concerning transfer of assets and liabilities in terms of the provisions in Part IX of the Water Act, 2016.
