(No. 8 of 1999)

REGULATION

PURSUANT to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, New Court Company Limited, is proposing to construct a fifteen-storey apartment block comprising 3 lower ground levels, one and two bedroomed apartment units with a total of Two hundred and Eighty Units, driveways, sidewalks, parking bays, development utilities (water, drainage, electricity, health and safety systems, IT systems & security) associated ancillary facilities and amenities on plot L.R No 3734/339 located in Kileleshwa off Othaya Road, Kilelcshwa, Nairobi County The following are the anticipated impacts and proposed mitigation measures: Negative Impacts Excessive noise and vibrations generation Mitigation Measures • Apply for a License from NEMA whereby maximum permissible noise levels are to be exceeded. • Prescribe appropriate noise reduction measures e.g. restricted working hours and transport hours and noise buffering. • Install portable barriers to shield compressors and other small stationary equipment where necessary and locate stationary noise sources as far from existing sensitive receptors as possible. • Use quiet equipment (i.e. equipment designed with noise control elements such as mufflers). • Ensure use of well serviced vehicles and equipment. • Limit trucks and other small equipment to minimize idling time and switch off idle engines whenever possible. • Provide 2.4-meter-high hoarding along site boundary. • Provide effective dust screen, sheeting or netting where a scaffolding is erected around the perimeter of the building under construction, from the ground floor level of the building up to the highest level of the scaffolding. • Water all active construction areas when necessary. • Cover all trucks hauling soil, sand and other loose materials or require all trucks to maintain at least two feet of freeboard. • Down wash of trucks tires prior to departure from site. • Vehicle idling time shall be minimized. Waste generation • Use of durable, long-lasting materials that will not need to be replaced as often, thereby reducing the amount of construction waste generated over time. Air pollution (dust and exhaust emissions) Possible Impacts Mitigation Measures Exposure to • Amount of chlorination chemicals stored on hazardous site shall be minimised while a sufficient chemicals inventory to cover intermittent disruptions in supply shall be maintained. • A prevention program that includes identification of potential hazards, written operating procedures, training, maintenance, and accident investigation procedures shall be developed and implemented. • A plan for responding to accidental releases shall be developed and implemented. Contamination of • Potential sources of contamination within the water at the headworks shall he identified and intake works collaboration with public authorities in the implementation of management approaches to protect the source water quality shall be effected. • Evaluate the vulnerability of the water source to disruption or natural events shall be evaluated and appropriate security measures implemented as necessary. • Random site inspections shall be effected. Contamination of • An alarm and safety systems, including drinking water automatic shutoff valves that are automatically from treatment activated when a chlorine release is detected operations shall be installed. • Use corrosion-resistant piping, valves, metering equipment, and any other equipment coming in contact with chlorine shall be effected. The equipment shall be kept free from contaminants, including oil and grease. • The water treatment facility shall be constructed, operated and maintained in accordance with national requirements and internationally accepted standards to meet national water quality standards and WHO Guidelines for Drinking Water Quality. • A prevention program that includes identification of potential hazards, written operating procedures, training, maintenance, and accident investigation procedures shall be developed and implemented. • The vulnerability of the treatment system shall be evaluated and appropriate security measures, such as background checks of employees, perimeter fencing and video surveillance and improvement the electrical power feeds to the facilities implemented.
