THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION ACT
(No. 8 of 1999)
REGULATION
PURSUANT to Regulation 21 of the Environmental Management
and Co-ordination (Impact Assessment and Audit) Regulations, 2003,
the National Environment Management Authority (NEMA) has
received an Environmental Impact Assessment Study Report for the
above proposed project.
The proponent, New Court Company Limited, is proposing to
construct a fifteen-storey apartment block comprising 3 lower ground
levels, one and two bedroomed apartment units with a total of Two
hundred and Eighty Units, driveways, sidewalks, parking bays,
development utilities (water, drainage, electricity, health and safety
systems, IT systems & security) associated ancillary facilities and
amenities on plot L.R No 3734/339 located in Kileleshwa off Othaya
Road, Kilelcshwa, Nairobi County
The following are the anticipated impacts and proposed mitigation
measures:
Negative Impacts
Excessive noise
and vibrations
generation
Mitigation Measures
• Apply for a License from NEMA whereby
maximum permissible noise levels are to be
exceeded.
• Prescribe appropriate noise reduction
measures e.g. restricted working hours and
transport hours and noise buffering.
• Install portable barriers to shield compressors
and other small stationary equipment where
necessary and locate stationary noise sources
as far from existing sensitive receptors as
possible.
• Use quiet equipment (i.e. equipment designed
with noise control elements such as mufflers).
• Ensure use of well serviced vehicles and
equipment.
• Limit trucks and other small equipment to
minimize idling time and switch off idle
engines whenever possible.
• Provide 2.4-meter-high hoarding along site
boundary.
• Provide effective dust screen, sheeting or
netting where a scaffolding is erected around
the perimeter of the building under
construction, from the ground floor level of
the building up to the highest level of the
scaffolding.
• Water all active construction areas when
necessary.
• Cover all trucks hauling soil, sand and other
loose materials or require all trucks to
maintain at least two feet of freeboard.
• Down wash of trucks tires prior to departure
from site.
• Vehicle idling time shall be minimized.

not need to be replaced as often, thereby
reducing the amount of construction waste
generated over time.

Possible Impacts Mitigation Measures

operating procedures, training, maintenance,
and accident investigation procedures shall be
developed and implemented.
• The vulnerability of the treatment system shall
be evaluated and appropriate security
measures, such as background checks of
employees, perimeter fencing and video
surveillance and improvement the electrical
power feeds to the facilities implemented.

Negative Impacts Mitigation Measures
• Sensitize truck drivers to avoid unnecessary
road obstruction.
• Cover all trucks hauling soil, sand and other
loose materials to avoid spillage and dust
emissions that may interfere with smooth
motoring.
Other mitigation measures are outlined within this
report.
