THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION ACT

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Kenya Ports Authority, proposes to develop Mombasa Special Economic Zone (SEZ) as a logistic and industrial base with components such as Free Port, Free Trade Zone (FTZ), industrial park and energy base. High grade and globally competitive infrastructure including power supply, water supply, water treatment and telecommunication, associated facilities and amenities will be developed in Mombasa and Kwale counties. The following are the anticipated impacts and proposed mitigation measures: Possible Impacts Mitigation Measures Minor accidents during survey work  Observe safety code of conduct in field work. Tension associated with proposals for cross-County water transfer  Intensified stakeholder engagement to explain broad scope, goals and benefits from PID. Displacement of people from land, investments and livelihood  Full implementation of the Abbreviated Resettlement Action Plan-ARAP. Elderly, poor, disabled persons affected by displacement  Implement Livelihood Restoration Programme as per ARAP. Disturbance to shrines and sacred sites and other heritage resources  None of the shrines will be traversed by PID. Nuisances-dust, noise, atmospheric pollutants, fumes, vibrations from operation of plant and equipment  Develop and implement an approved equipment deployment plan inclusive of maintenance and monitoring plan. Generation of Green House Gases in transportation of construction materials  Local sourcing of materials to minimize transportation footprint. Pollution from construction waste, waste oils and spares  Apply the 3R rule of Reduce, Recover and Recycle waste. OHS concerns in construction  Develop and implement Health and Safety Plan with clear budgetary allocation. Disruption of life by noise, truck movement, dust etc. in soil transport  Implement an approved Traffic/ Transport Safety Plan. Minor loss of carbon sinks in destroyed cover vegetation  Minimize logging, then replace lost tree species. Risk of fire hazards from construction camp  Develop and implement Construction Plan including OSHA Plan. Socio-impacts including sanitation concerns from construction crew and labour camps  Develop and follow Construction Plan including OSHA plan to include local sourcing for labour and personnel. Concerns on HIV and AIDS  Local sourcing of labour, aggressive campaign and VCT services. Degradation of the Tiwi Aquifer  Aquifer monitoring study before and after commissioning.  Waste water recovery through a Common Effluent Treatment Plant-CEMP. 1368 1368 Possible Impacts Mitigation Measures Political/Social tension over cross- county water transfer  Continuous monitoring on Tiwi Aquifer. Switch sourcing to Mwache dam when operational. The National Environment Management Authority invites members of the public to submit oral or written comments within thirty (30) days from the date of publication of this notice to the Director-General, NEMA, to assist the Authority in the decision making process regarding this plan.
