REGISTRATION
PURSUANT to section 8 of the Statutory Instruments Act, 2013,
the Cabinet Secretary for ICT, Innovation and Youth Affairs notifies
the general public that a Regulatory Impact Statement on the proposed
Data Protection (Registration of Data Controllers and Data Processors)
Regulations, 2021 has been prepared to assess the impact of the
Regulations on the community and businesses.
The main objective of the proposed regulations is to facilitate the
registration of data controllers and data processors pursuant to Part III
of the Data Protection Act, 2019 (‘the Act’). Specifically, the
Regulations seek to provide for—
(a) the procedure for registration of data controllers and data
processors;
(b) the procedure for renewal of registration;
(c) the charging of regulatory fees by the Data Commissioner;

(d) the creation of offences for breaches under the Regulations;
and
(e) the imposition of fines by the Data Commissioner.
This is therefore to request all persons likely to be affected by the
proposed Regulations to submit written memorandum to reach the
undersigned within fourteen (14) days from the date of publication of
this notice to the email address dataprotectionregulations@odpc.go.ke.
The draft Regulatory Impact Statement and the proposed
Regulations are available on www.odpc.go.ke.
