PURSUANT to the provisions of section 25 of the Competition Act, 2010, (“the Act”), the Competition Authority of Kenya (CAK) notifies the public that the Cereal Millers Association (a members association for the grain milling industry for wheat, maize and other cereal crops) has made an application for exemption on certain sections of the Act with regards to potential Restrictive Trade Practices for a period of twelve (12) Months (1 Year), relating to information sharing with its members and certain government bodies. In particular, Cereal Millers Association (CMA) is seeking to be exempted with respect to the following: (a) participate in the meetings to discuss the prices of local wheat production and prices for farmers for the wheat buying programme as well as agree on the minimum price per bag of wheat grain; (b) allocate locally produced wheats among its members to support the farmers by ensuring that all local wheat is purchased from each farmer and from each region, as well as to approve the application for East African Community (EAC) duty remission scheme Gazettement; and (c) share local wheat purchase information with CMA Wheat Milling Members and Agriculture and Food Authority (AFA), Ministry of Agriculture (MoA) and National Treasury and Planning. The above conduct, if not exempted, will qualify as contraventions under the Act, hence the application for exemption.
