THE WATER ACT
(No. 43 of 2016)
APPOINTMENT
IT IS NOTIFIED for the general information of the public that the
Cabinet Secretary for Water, Sanitation and Irrigation has appointed a
National Task Force to—
(a) analyze and propose sustainable modalities on restructuring
debts for development of water and sanitation infrastructure
owed to development partners by both Water Works
Development Agencies (W DAs) and Water Service Providers
(WSPs);
(b) develop a National Water Sector Investment and Financing
Plan in the country pursuant to section 64 (3) (d), 68 (d) and
72(1)(g) of the Water Act, 2016.
The Taskforce shall comprise of the following—

Terms of Reference
(a) Restructuring of Debt Owed to Development Partners
1. Study and analyze the Water and Sanitation Sector Debt
portfolio and provide a comprehensive report on debt owed to
Development Partners by WWDAs and WSP in the country.
2. Recommend in consultation with the respective county
government applicable modalities on debt restructuring including but
not limited to determining amount of debt transferable from WWDAs
to WSPs and which WSPs can sustainably repay against advanced loan
amounts for the development of water and sanitation infrastructure,
accumulated interests, penalties and arreas up to FY 2020/2021 and
determine amounts that can be recommended for waiver.
3. Determine the applicable depreciation rates/levels of the water
infrastructure developed through the subject loans.
4. Recommend strategies on debt recovery from WSPs while
ensuring their sustainability and continuity in service delivery.
5. Develop a performance based criteria to inform future
investments by National Government in WSPs.
6. Develop a road map to inform future investment plans by the
National Government in WSPs for efficient and effective service
delivery.
7. Undertake any other task as may be assigned from time to time
during the life of the Taskforce by the Cabinet Secretary.
(b) Development of the National Water Sector Investment and
Financing Plan
(i) Develop a National Water Sector Investment Plan.
(ii) In consultation with each county government, develop county
specific financing options.
(iii) Develop fiscal and structural policies to support financing in
the sector.
(iv) Develop a concept paper on strategic interventions by both
national and county Governments for realization of the right to
water and reasonable standards of sanitation.

2. In the performance of its mandate, the Taskforce—
(a) shall hold such number of meetings in such places and at
such times as the Taskforce shall, in consultation with the
Cabinet Secretary consider necessary for proper discharge
of its functions;
(b) may use strategies, policies and legislation relevant to its
mandate;
(c) may carry out or cause to be carried out such studies and
researches as may inform the Taskforce on its mandate
with the approval of the Cabinet Secretary;
(d) may with the approval of the Principal Secretary, Ministry
of Water, Sanitation and Irrigation engage the services of
such consultants as may be found necessary for the
performance of its mandate;
(e) may undertake field assessments and investigations;
(f) may identify and co-opt technical experts or any other
resource provided that the co-opted members do not exceed
one-third of the taskforce members;
(g) shall call for and subpoena any relevant documents and
information in the possession, custody or control of any
relevant institution or process.
3. The Taskforce shall regulate its own procedures.
4. The term of the Taskforce shall be sixty (60) days from the date
of publication of this notice; provided that the Taskforce shall submit
to the Cabinet Secretary an Interim Report within thirty (30) days.
5. The Secretariat of the Taskforce shall be based at the
Headquarters of the Ministry of Water, Sanitation and Irrigation in
Maji House, Nairobi and all communication will be addressed to the
chairperson of the Taskforce.
