THE AFFAIRS OF THE ASSUMPTION OF THE OFFICE OF COUNTY GOVERNOR COMMITTEE – SEPTEMBER 2022 INTRODUCTION The Assumption of the Office of Governor Act
ESTABLISHMENT
Pursuant to section 5 (1) of the Act, the County
Government of Kiambu established the Assumption of the Office of
County Governor Committee. Section 18 of the Act requires that the
committee prepare a report on its affairs within a period of one month
from the date of the swearing-in of the County Governor-elect, submit
the same to the County Assembly and publish the report in the
Gazette.
Membership of the Assumption of the Office of County Governor
Committee
The membership of the Assumption of the Office of County
Governor Committee as per section 5(2) comprised of—
(a) the County Secretary who shall be the Chairperson;
(b) the officer in-charge of legal matters in the county;
(c) the Chief Officer in the Department responsible for matters
relating to county public service;
(d) the Chief Officer in the Department responsible for matters
relating to information and communication;
(e) the Chief Officer in the Department responsible for matters
relating to Finance;
(f) the Chief Officer in the Department responsible for matters
relating to culture and social services;
(g) a representative of the Ministry responsible for matters related
to devolution;
(h) the County Commissioner;
(i) a representative of the National Intelligence Service at the
county level;
(j) a representative of the National Police Service at the county
level;
(k) the Clerk of the county assembly;
(l) a representative of the Judiciary at the county level; and
(m) two persons, one man and one woman nominated by the
Governor-elect.
Section 5 (3) of the Act states that the Chief Officer in the
Department responsible for matters relating to the county public
service shall be the secretary to the Committee.
Functions and powers of the Assumption of the Office of County
Governor Committee
The functions of the Assumption of the Office of County Governor
Committee as per section 6 of the Act are—
(a) to facilitate the handing over process by the outgoing Governor
to the Governor-elect;
(b) ensure and coordinate the provision of security services to the
Governor-elect;
(c) put in place the necessary facilities and deploy the necessary
personnel for the Governor-elect upon assumption of office;
(d) co-ordinate the briefings of the Governor-elect by the relevant
county public officers including submission of the following
information—
(i) an up-to-date assets register;
(ii) an up-to-date register of liabilities
(iii) a complete list of all bank accounts and reconciled
balances;
(iv) a report of staff establishment per department;
(v) a comprehensive report on county entities or corporations
and agencies containing information outlined in (i) to (iv)
(vi) a report of all ongoing projects including donor funded
(vii) an up to date report on all pending legal cases; and
(viii) county source of funding.

(e) facilitate communication between the outgoing Governor and
the Governor-elect;
(f) prepare the program and organize for the swearing-in
ceremony;
(g) prepare the oath and certificate of inauguration; and
(h) carry out any other activity necessary for the performance of its
functions under the Assumption of the Office of Governor Act,
2019 and perform any other function assigned to it under any
other written law.
Formation of Sub-Committees
Pursuant to section 7(1) of the Act, the committee established three
(3) sub-committees which were necessary for the better carrying out of
its functions.
(a) Budget and Finance Sub-Committee
The sub-committee was tasked with the preparation of the budget
for the assumption of the office of Governor Committee, co-ordination
of the preparation of the departmental and financial reports.
(b) Co-ordination, Communication and Logistics Sub-Committee
The Sub-committee was in charge of protocol, logistics of the
swearing-in ceremony, hospitality, entertainment, identification of the
venue for the swearing-in ceremony, preparation of the swearing-in
documents and assembling of the instruments of power.
(c) Security Sub-Committee
The sub-committee was tasked with the provision of security to the
Governor-elect and the Deputy Governor-elect, provision of security
and traffic control during the swearing-in ceremony
ACTIVITIES OF THE COMMITTEE
The Assumption of Office of Governor Committee and sub-
committees held several meetings in preparation for the handing over
process by the outgoing Governor to the Governor-elect. The
deliberations and resolutions of the said meetings are contained in the
minutes. Every member and staff assigned to the committee signed a
confidentiality agreement in line with section 20(4) of the Assumption
of the Office of Governor Act, 2019. The committee undertook the
following activities.
(i) Inaugural Meeting
The Assumption of Office of County Governor Committee held its
first meeting on 8th July, 2022. During this meeting, the Chairperson
took the members through the Assumption of the Office of Governor
Act, 2019 for them to understand their roles and responsibilities. The
members developed a work plan that would guide their activities.
(ii) Co-ordination of the provision of security services to the
Governor-elect and Deputy Governor-elect
Upon declaration of the final result of the Governor-elect by
Independent Electoral and Boundaries Commission, the Committee
through the County Commissioner provided security to the Governor-
elect and Deputy Governor-elect.
(iii) Put in place the necessary facilities and personnel for the
Governor-elect and Deputy Governor-elect
The Committee through the Chairperson made the necessary
arrangements on office accommodation for both the Governor-elect
and Deputy Governor-elect and deployed the necessary personnel.
(iv) Co-ordination of the briefings of the Governor-elect by
relevant County Public Officers
The Committee through the Chairperson facilitated briefings of the
Governor-elect by the County Executive, County Public Service Board
and the County Assembly. The briefings were done in accordance with
section 6 (1) (d) of the Assumption of the Office of Governor Act
,2019.
(v) Co-ordination of the provision of information from the
County Departments pursuant to Section 6 (1) (d)
The Accounting Officers responsible for the County Departments,
County Public Service Board and County Assembly provided county
information as per the format provided in the Second Schedule of the
Act to the Committee through the Chairperson.
The information submitted by the County Departments, County
Public Service Board and the County Assembly detailed; up to date
assets register, up to date register of liabilities, list of all bank accounts
and reconciled balances, a report of staff establishment per
department, a report on county entities or corporations and agencies, a
report on all ongoing projects including donor funded projects, a report
on all pending legal cases and the County source of funding.
On the County assets, the departments provided information on the
assets inherited from the Defunct Local Authorities, those earmarked
for transfer from National Government for devolved functions and
those acquired by the County Government since 2013.
(vi) Facilitation of communication between the outgoing
Governor and the Governor-elect
The Committee through the Chairperson and the County
Commissioner facilitated communication between the outgoing
Governor and the Governor-elect.
(vii) Swearing-in Ceremony
Prior to the swearing-in ceremony, the committee gazetted the
date, the time and the venue for the swearing in ceremony vide
