GAZETTE NOTICE NO. 432
THE CONSTITUTION

REGULATION
IN EXERCISE of powers conferred by Articles 88 (4), 98, 99, 101
of the Constitution of Kenya, sections 2, 16, 20, 24, 26, 28, 29, 30, 31,
32, 33, 35, 38, 39, 43 and 74 of the Elections Act, 2011 and
Regulations 11(4), 12(1) and 14, and Parts III, VI and IX of the
Election (General) Regulations, the Independent Electoral and
Boundaries Commission gives notice that:
(a) An election is to be held on the Tuesday, 9th August, 2022
for Members of Senate for each of the counties set out in the
Second Schedule hereunder;
(b) political Parties shall submit the Party Membership lists to
the Commission on or before Saturday, 9th April, 2022.
(c) political parties intending to present candidates in the
election shall submit the names of persons contesting in the
party primaries, the date and venues of the primaries on or
before Saturday, 9th April, 2022, being 21 days before the
nomination day.
(d) The Commission shall publish, in the Gazette the names of
the persons contesting in a party primary and the date of the
party primary within seven (7) days of receipt of the names
of the candidates.
(e) A political party intending to present candidates in this
election shall conduct its primaries and resolve intra-party
disputes on or before the Friday, 22nd April, 2022.
(f) A political party intending to present candidates through
direct nominations or party primaries shall submit the names
of the persons nominated to contest in the election to the
Commission on or before the Thursday, 28th April, 2022.
(g) Candidates intending to participate in this election as
independent candidates shall not be members of any
registered political party by Monday, 2nd May, 2022 being at
least 3 months before the General Election.
(h) Candidates intending to participate in this election as
independent candidates shall submit their names and symbols
they intend to use during the election to the Commission on
or before Monday, 2nd May, 2022.
(i) The Commission shall publish in the Gazette, the names and
symbols of persons intending to contest in the election as
independent candidates at least fourteen (14) days before the
nomination day being on or before Friday, 13th May, 2022.
(j) A public officer who intends to contest in the General
Election shall resign from public office within six (6) months
before the date of Election being on or before Wednesday,
9th February, 2022.
(k) The days for the nomination of political party candidates and
Independent candidates for the Senate Elections shall be
between Sunday, 29th May, 2022 and Tuesday, 31st May,
2022. The nomination papers shall be delivered by candidates
to the respective Returning Officers between the hours of
eight O’clock in the morning and one O’clock in the
afternoon and between the hours of two O’clock and four
O’clock in the afternoon at the place designated by the
Commission.
(l) Disputes relating to or arising from nominations shall be
determined within ten (10) days of the lodging of the dispute
with the Commission. The lodging of the dispute shall not be
later than Thursday, 9th June, 2022.
(m) The campaign period for purposes of the Tuesday, 9th
August, 2022 General Election shall commence Sunday, 29th
May, 2022 and cease on Saturday, 6th August, 2022 being 48
hours before the General Election Day.
(n) political parties intending to participate in the General
Election shall submit to the Commission their Party Lists on
or before Saturday, 25th June, 2022.
(o) The Campaign time shall run from 7.00 a.m. to 6.00 p.m.
during the campaign period.
(p) political parties and candidates shall appoint and submit to
the Commission the names of the County Tallying Centre
Election Agents to the Commission on or before Monday,
25th July 2022.
(q) If the elections are contested, the poll will take place on the
Tuesday, 9th August, 2022.
NOTES:
1. The attention of candidates and persons subscribing
nomination papers is drawn to the provisions of Parts III, VI
and IX of the Election (General) Regulations, Section 13(2)
and the First Schedule to the Leadership and Integrity Act No.
19 of 2012 and Chapter Six of the Constitution of Kenya.
2. Every political party, candidate and every person who
participates in the election shall subscribe to and observe the
Electoral Code of Conduct set out in the Second Schedule to
the Election Act, 2011.
3. A person guilty of an election offence will be liable to the
penalties imposed by the Election Offences Act, 2016 (No.37
of 2016), the disqualifications imposed thereof and the
Constitution of Kenya.
4. The attention of candidates is drawn to the provisions of
section 26 of the Elections Act, 2011.
5. The attention of political party candidates and independent
candidates is drawn to Section 29 of the Elections Act, 2011
and Regulation 15 of the Election (General) Regulations, 2012.
6. The attention of political Parties, Candidates and every person
who participates in the election is drawn to section 2.
