WHEREAS the Judicial Service Commission has submitted to the President a Petition for the removal from office of the Hon. Justice Said Juma Chitembwe, Judge of the High Court of Kenya, under the provisions of Article 168 of the Constitution; Whereas the Petition is further to the findings of the Judicial Service Commission that the constitutional grounds for removal of the Judge under Articles 168 (1) (b) and 168 (1) (e) of the Constitution have been met; and Whereas Article 168 (5) of the Constitution requires that upon receiving such a Petition from the Judicial Service Commission the President shall suspend the Judge from office and thereafter appoint a tribunal to inquire into the matter. Now Therefore, having received and considered the Petition of the Judicial Service Commission and in exercise of the powers conferred by Article 168 (5) (b) of the Constitution of Kenya, as read together with section 31 of the Judicial Service Act, 2011, I, Uhuru Kenyatta, President and Commander-in-Chief of the Kenya Defence Forces, do hereby direct as follows: 1. The Hon. Justice Said Juma Chitembwe, Judge of the High Court of Kenya, be and is hereby suspended from office with immediate effect; and 2. A Tribunal to inquire into the matter be and is hereby appointed, constituted as follows: Chairperson Hon. Lady Justice Mumbi Ngugi Members Fred N. Ojiambo (Dr.), SC Hon. Lady Justice Abida Ali Aroni Hon. Justice Nzioki wa Makau James Ochieng Oduol Lt. Gen. (Rtd.) Jackson W. Ndungu Lydia Nzomo (Dr.) Lead Counsel Kiragu Kimani, SC Joint Secretaries Jasper M. Mbiuki Sarah Yamo Assisting Counsels Edward Omotii Nyang’au Joseph Gitonga Riungu 3. The mandate of the Tribunal shall be to consider the Petition for the removal of the Hon. Justice Said Juma Chitembwe from office that was submitted by the Judicial Service Commission and to inquire into the allegations therein. 4. In the discharge of its functions, the Tribunal shall: (a) Prepare and submit a report and its recommendations thereon expeditiously; and (b) Exercise all the powers conferred upon it by law for the proper execution of its mandate.
