THE CONSTITUTION
ESTABLISHMENT
in accordance with Section 18 of
the Act.
Composition of the Committee
Section 5 (1) establishes the Assumption of the Office of the
Governor Committee whereas Section 5(2) sets out an ad hoc
committee and its membership.
Pursuant to the provision of section 5(2) intimated above, a
Committee comprising of the following members was formed;
Muigai Wainaina – County Secretary — Chairperson
Amos Gikaro Mariba – County Commissioner
Hon. Justice Charles Kariuki – Presiding Judge Nyandarua High
Court
John Maina Kibaara – County Intelligence Co-ordinator
Paul Karobia – Deputy County Police Commander
Fredrick Mwangi Kanini – Representative of the Ministry of
Devolution
Patricia Njeri Wanjiru – Legal Advisor
Juvenalis G. Thiongo – Chief Officer Finance
Nelson Kimilu – Chief Officer Education, Culture and the Arts
Isaac Waithaka – Chief Officer Youth, Sports, Gender and Social
Services
Simon Njogu Mwaura – Clerk to the County Assembly
Peter Waweru Thiari – Governor elect nominee
Mary Wanjiku Kamande – Governor elect nominee
Mary Ndorongo — Chief Officer Public Administration and ICT
(Secretary)
Pursuant to sction 5 (10) the term of office of the Committee shall
lapse upon the submission of its report to the County Assembly in
accordance with Section 18(2) of the Act.
Functions of the Committee
Section 6 of the Act sets out the functions of the Committee the
major ones being to; Facilitate the handing over process by the
outgoing Governor to the Governor Elect, Co-ordinate the briefings of
the Governor Elect by the relevant county public officers including
submission of information as listed out under Section 6(1)(d) (i-vii);
and Organize the swearing in ceremony.
Activities of the Committee
The Chairperson of the Committee was required to call for the first
meeting thirty days (9th July, 2022) before the date of the general
elections (9th August 2022) as per Section 5(6) of the Act.
Subsequently, the Committee had its first sitting on 7th July 2022. In its
first sitting and in compliance with Section 20(4) of the Act, every
member of the Committee signed a confidentiality agreement. The
Committee also established its work schedule (work plan) including
the establishment of the Sub-Committees and co-option of members in
accordance with Section 7(1) and (2) of the Act.
The Committee established various Sub-Committees which
included; Legal, Finance, Budget & Planning, Coordination,
Communication & Logistics, Security and Public Service.
The Committee had Fourteen (14) sittings whose deliberations and
resolutions are contained in its minutes.
Legal Sub-Committee
As per the Terms of Reference developed by the Committee , the
legal sub-committee in liaison with the judiciary advised and handled
legal enquiries ,prepared confidentiality agreements ,gazetted the
swearing in ceremony (Kenya Gazette Vol. CXXIV – No. 166 Gazette
notice number 9882 of Friday 19th August, 2022), assembled and kept
safe custody instruments of power, prepared and provided the oaths of
office and certificate of inauguration, prepared an up to date report of
all legal cases, fees and liabilities; and gazetted the Committee report
upon instructions by the Committee. The Office of the County
Attorney also liaised with regional Ethics and Anti-Corruption
Commission (EACC) for their role in the administration of the
leadership and integrity code of conduct.
Finance, Budget and Planning
The sub- committee facilitated provision of budgeted funds for
utilization by the Committee in its activities. Further, the sub-
committee coordinated provision and preparation of reports in
accordance with Section 6(d) of the Act as per templates in the Second
Schedule of the Act. The report contained information detailing; an up
to date assets register, an up to date register of liabilities, a complete
list of all bank accounts and reconciled balances, a comprehensive
report on county entities or corporations and agencies containing
information outlined in Section 6(1)(d) (i) to (iv) of the Act; county
source of funding and all ongoing projects including donor funded
projects.
Co-ordination, Communication and Logistics
The Committee coordinated logistical arrangements relating to the
event. It facilitated communication between the outgoing Governor
and the Governor-elect; Prepared the programme and organised for the
swearing-in ceremony; i.e logistics on venue, transport, driveways and
parking areas, band and guard of honour, entertainment, tents and
seats, public address system, luncheon and other necessary facilities
for the organization of the swearing-in; and sent out invitations (both
in print and electronic media), and coordinated the live coverage of the
swearing -in ceremony.
Public Service
This committee majorly co-ordinated the briefings of the
Governor-elect by the relevant county public officers including
submission of information as stated under Section 6 (d) (i-viii) of the

Act, prepared a report of staff establishment per department; and Put in
place the necessary facilities and deployed the necessary personnel for
the Governor-elect upon assumption of office.
Security Sub-Committee
The sub-committee ensured provision of adequate security to the
Governor and Deputy Governor Elect after declaration of results by
IEBC, during and after the swearing in ceremony. The committee
mobilized for security to cater for ; traffic /crowd control, general
security coverage ,parade by NYS and enforcement officers.
Swearing in Ceremony
The swearing in ceremony took place on 25th August 2022 at the
Arboretum Grounds located within Ol’Kalou Town. The
administration of oaths was presided over by Honourable Lady Justice
Cecilia Githua, assisted by Honourable Chief Magistrate Patricia
Gichohi. H. E the Governor, (Dr.) Moses N. Badilisha signed the
inauguration certificate and the commitment to the leadership and
integrity code within the stipulated time as per the Act. The Deputy
Governor H.E Hon John Mathara Mwangi also took the oath and
signed the integrity code. Thereafter, the instruments of power were
presented to the Governor by the Chairperson of the Assumption of the
Office of the Governor Committee.
The event was attended by over 5000 persons and the event was
graced by members of National Assembly, senators, members of
diplomatic corps, members of County Assembly, Senior National and
County Government officials, members of the judiciary, international
dignitaries, business leaders, religious leaders, council of elders,
County Government staff, residents of Nyandarua and the general
public.
Financial Statements of the Committee
The Committee utilized a total of Kshs. 8,172,492/= to facilitate all
activities for the Assumption of the Office of Governor.
