LADY JUSTICE LUCY NJUGUNA ORDER Claims in the Application 1. THAT this application be certified urgent and the same be heard Ex-Parte on a priority basis in the first instance. 2. THAT this Honourable Court be pleased to issue a preservation order restraining the Interested Party, his employees, agents and/or representatives acting on his behalf, prohibiting the sale, transfer or disposing off or other dealings with the boat MV Igor christened as “MASHAALLAH” which has no registered owner and currently in the custody of Kenya Navy Mtongwe. 3. THAT the Honourable Court be pleased to issue an order authorizing the Commander Kenya Navy to seize, manage and safe keep the boat known as MV Igor christened as “MASHAALLAH” specified in prayer 2 seized on 20th October, 2025, pending issuance orders of this Court. 4. THAT an order be issued directing the Director General of Kenya Maritime Authority to register caveat against the records of the boat MV IGOR christened as “MASHAALLAH” specified in order 2 above. 5. THAT an order be issued directing the Director General of Kenya Maritime Authority to restrict the movements of the boat MV IGOR christened as “MASHAALLAH” specified in order 2 above. 6. THAT the Honourable Court be pleased to issue an order for substituted service of the order sought in prayer 2 above in a newspaper of wide circulation. 7. THAT the Honourable Court do make any other ancillary orders it may deem fit and necessary for the proper and effective execution of its orders. 8. THAT costs be provided for. Ex-Parte; UPON READING the Application dated 9th December, 2025 brought under certificate of urgency by Counsel for the Applicant under sections 81, 82 and 84 of the Proceeds of Crime and Anti- Money Laundering Act and Order 51 rule 1 of the Civil Procedure Rules and all enabling provisions of the law, and upon reading the supporting affidavit of Martin Samburumo sworn on the 9th December, 2025 and the annextures thereto; IT IS HEREBY ORDERED 1. THAT a Preservation Order be and is hereby issued restraining the Interested Party, his employees, agents, and/or representatives acting on his behalf, prohibiting the sale, transfer or disposing off or other dealings with the boat MV Igor christened as “MASHAALLAH” which has no registered owner and currently in the custody of Kenya Navy Mtongwe. 2. THAT an order be and is hereby issued authorizing the Commander Kenya Navy to seize, manage and safe keep the boat known as MV Igor christened as “MASHAALLAH” specified in Prayer 1 seized on 20th October, 2025, pending issuance orders of this Court. 3.
