ESTABLISHMENT


PURSUANT to section 8 of the Statutory Instruments Act, 2013, the Cabinet Secretary for Mining, Blue Economy and Maritime Affairs notifies the general public that a Regulatory Impact Statement on the proposed Merchant Shipping (Maritime Transport Operations) Regulations, 2023, (the “proposed Regulations”) has been prepared to assess the impact of the proposed Regulations on the community and businesses. The proposed Regulations have been made pursuant to section 8 (gg) and (h) of the Merchant Shipping Act, 2009 (No. 4 of 2009). The main objective of the proposed Regulations is to give full effect to the Merchant Shipping Act, 2009, and the applicable international conventions ratified by Kenya, by providing a framework for the effective and efficient regulation of maritime transport operations and logistics service providers. Specifically, the proposed Regulations seek to— (a) set out the procedure for the issuance, renewal, modification, suspension and revocation of licenses for maritime transport operators; (b) set out the registration procedure for maritime transport operators licensed by related Government agencies; (c) establish a framework to revise and introduce other fees and charges payable by maritime transport operators; (d) outline the scope of service for maritime transport operators; (e) provide a mechanism for co-ordination and collaboration for maritime transport and logistics services; (f) promote professionalism through continuous capacity building within the maritime transport sector; (g) promote the participation of Kenyan citizens in the maritime transport and logistics sector; (h) provide a complaints resolution mechanism; (i) provide processes for the establishment of performance standards; and (j) provide compliance and enforcement mechanisms in the provision of maritime transport and logistics services. This is therefore, to request the public and all persons likely to be affected by the proposed Regulations to submit written memoranda to reach the undersigned within fourteen (14) days from the date of the publication of this Notice.
