THE CONSTITUTION
APPOINTMENT
WHEREAS Article 27 of the Constitution provides for the equality of every person, freedom from discrimination and, in clause (8), requires the State to take legislative and other measures to implement the principle that not more than two-thirds of the members of elective or appointive bodies shall be of the same gender;
WHEREAS Article 81 (b) provides that the electoral system shall comply with the principle that not more than two-thirds of the members of elective public bodies shall be of the same gender;
WHEREAS there have been several unsuccessful attempts by the Government to establish a framework for the implementation of the Two-thirds Gender Principle;
WHEREAS Executive Order No. 1 of 2023 has conferred on the Ministry of Public Service, Gender and Affirmative Action with the mandate to develop gender and affirmative action policies and legislative proposals;
NOW THEREFORE, to actualize the realization of the Two-Thirds Gender Principle in a consultative and participatory manner in accordance with Article 10 and Article 232 of the Constitution, the Cabinet Secretary for Public Service, Gender and Affirmative Action has appointed the Multi-Sectoral Working Group on the Realization of the Two-Thirds Gender Principle which shall comprise of:

1. The terms of reference of the working group shall be—
(a) To review and analyse previous proposals for the implementation of the two-thirds Gender Principle;
(b) To conduct comparative studies on best practices in other jurisdictions towards the achievement of gender equality;
(c) To engage such experts or institutions as may be necessary to achieve the objectives of the Working Group;
(d) To develop and recommend a framework for the implementation of the Two-Thirds Gender Principle;
(e) To conduct stakeholder engagement and undertake public participation on the proposed framework for the implementation of the Two-Thirds Gender Principle;
(f) To mobilise resources towards the achievement of the objectives of the Working Group; and
(g) To perform such other function as may be approved by the
Cabinet Secretary for the achievement of the objectives of the Working Group.
2. In the discharge of its functions, the Working Group may—
(a) regulate its own procedure;
(b) co-opt experts as may be necessary for the achievement of the objectives of the Working Group; and
(c) create sub-committees for the efficient discharge of its functions.
3. The Working Group shall serve for a term of six (6) months from the date of the publication of this notice in the Gazette.
4. The Secretariat of the Working Group shall be based at the State Department for Gender at Teleposta Towers Building, Fourth
Floor.
