THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION ACT
(No. 8 of 1999)
REGULATION
PURSUANT to Regulation 21 of the Environmental Management
and Co-ordination (Impact Assessment and Audit) Regulations 2003,
the National Environment Management Authority (NEMA) has
received an Environmental Impact Assessment Study Report for the
above-proposed project.
The proponent, Intex Construction Limited proposes to construct
18 residential blocks(A-R) containing a total of 4054 units, a primary
school, and a commercial Centre as follows, one room units 1740, two
room units 1690, three room units 624. The residential blocks consist
of storey building ranging from the least being 10 floors to 17 floors.
Other associated facilities are perimeter wall, parking arrangement and
paved internal roads and landscaping of green areas, on Plot L.R. No.
106/1484, Soweto East Sub-location, Langata Sub-county, Nairobi
County.
The following are the anticipated impacts and proposed mitigation
measures:

Waste management
(construction wastes)
• Waste materials will be segregated on-
site into appropriate containers and
removed from site by suitably permitted
waste contractors to authorized waste
landfills.
• Where possible, reusable waste materials
will be reused on-site to minimize raw
material consumption.
• All construction staff will be provided
with training regarding the waste
management procedures.
• All waste materials will be stored in
color coded bins or other suitable
receptacles in designated, easily
accessible locations.
• The contractor will adhered to the
provisions of Environmental
Management and Coordination Act
Potential Impacts Mitigation Measures
EMCA (Waste Management Regulation
2006) and Sustainable Waste
Management Act, 2022..
Noise and vibration • Construction working hours will be
restricted to daytime.
• Vehicles and machineries will be
maintained in a good and effective
working order and operated in a manner
to minimize noise emissions.
• All pneumatic tools will be fitted with
silencers/mufflers.
• Vehicles should be prohibited from
waiting within the site with their engines
running or alternatively, located in
waiting areas away from sensitive
receptors.
• Local hoarding, screens or barriers
should be erected to shield noisy
activities.
Air quality (increased
atmospheric particle
concentrations)
• Water misting, or sprays shall be used as
required if particularly dusty activities
are necessary during dry or windy
periods.
• Any access site roads with the potential
to give rise to dust will be regularly
watered.
• Material handling systems and site
stockpiling of materials shall be laid out
to minimize exposure to wind.
• Ensure that all vehicles are suitably
maintained to ensure that emissions of
engine generated pollutants is kept to a
minimum.
• Fully enclose specific operations where
there is a high potential for dust
production.
• Impose and signpost a maximum-speed-
limit of 20Kph (surfaced) and 10Kph
(unsurfaced) access roads and work areas
Transport, movement,
and access (traffic)
• Construction traffic routing will be
generally confined to major highways,
avoiding residential narrow local slum
access routes.
• Appropriate parking facilities for site
operatives and visitors within the site
will be provided with all parking areas
clearly marked;
• Temporary warning signage will be
installed, as necessary.
• • Ensure construction machineries are
not parked on the road shoulders.
Social impacts • The contractor will implement a non-
discriminatory hiring and wage policy
(clearly stating that the company will not
discriminate in hiring and salaries based
on gender, age, religion, ethnicity or
place of origin).
• Prioritize employment of local people for
construction works.
• The contractor will strictly implement
zero tolerance for sexual harassment at
the work place.
Generation of solid
waste
• The proponent will abide by the Nairobi
County (Solid Waste Management Act,
2015), Environmental Management and

Co-ordination Act EMCA (Waste
Management Regulation 2006) and
Sustainable Waste Management Act,
2022 in managing and disposing solid
wastes from the housing units.
• Spent oil from the backup Diesel
Generator (DG) sets should be stored in
HDPE drums in isolated covered facility
and disposed of as per the Hazardous
Wastes regulations.
• Waste management awareness
Programme will be up scaled amongst
the residents.
Community health and
safety
• Contractor shall provide regular health
and safety training to their workers
which will include sessions on social and
cultural awareness.
• The Contractor will liaise with Health
institutions and health workers to
develop and implement an
HIV/AIDS/early pregnancy policies and
information document for all workers
directly related to the project.
• The Contractor shall develop an
induction program, including a Code of
Conduct, for all workers directly related
to the Project.
• Awareness raising regarding sexually
transmitted diseases (STD) should be
provided to workforce.
Effluent discharge
(sewerage and waste
water)
• All waste water and sewerage will be
channelled into the existing sewerage
system provided by NCWSCo and
supplemented with bio-digester.
Prevalence of flooding
(storm water and
drainage)
• Provision of adequately sized storm
water drainage system to prevent over
flooding of the site and nearby facilities.
Storm water collection system has been
designed so as to accommodate the entire
amount of outflow, that may occur after
development consisting of box culverts
measuring (10m by 4m by 3m).
• Storm water shall be channelled into an
existing storm water drainage system
(Kibera Canaan drainage system).
Fire outbreaks • Firefighting systems should be designed
in compliance with the Factories & Other
Places of Work (Fire Risk Reduction)
Rules, 2007.
• All hydrant outlets should be provided
with protective caps to help prevent
vandalism.
• Training and awareness programs will be
rolled out at household-level, with focus
to use of equipment (overloaded electric
sockets, positioning of the stove; high
risks of LPG gas cylinders).
• Fire alarms should be placed in every
floor of each units.
• Upscale public education and fire
prevention measures.
Occupational health
and safety
• Adherence to Occupational Health and
Safety Act 2007 and Employment Act,
Cap. 226.
Increased energy use • The project proponent should provide
guidelines to the users to ensure
conservation of energy. In-house

environmental awareness campaigns
should be carried out at regular intervals
to ensure energy conservation measures
are followed.
• Use of energy efficient electrical systems
should be promoted and encouraged.
High efficiency lamps with electronic
ballasts should be used.
• The power cabling shall be adequately
sized as to maintain the distribution
losses not to exceed 1% of the total
power usage.
• The project proponent should incorporate
solar energy at least for street lighting
and other common place.
• Use of energy efficient lighting systems
e.g. High Pressure Sodium Vapour
(HPSV) Lamps, LED etc. shall be used
and promoted.
Soil erosion and
sedimentation
• The contractor shall stabilize stream
banks as early as possible including
installation of principal runoff
conveyance system with runoff-control
measures (Ngong River lining) using
gabions and stone pitch.
• The contractor will install and stabilized
discharge points and downgradient
perimeter controls such as silt trap fence.
• The contractor will stabilize all disturbed
areas, slopes, and drainage systems
within fourteen (14) days.
