THE CONSTITUTION
BILL
IN EXERCISE of the mandate of the Salaries and Remuneration
Commission (SRC), as provided under Article 230 (4) (a) of the
Constitution of Kenya, 2010, Salaries and Remuneration Commission
reviewed and set the remuneration and benefits for State officers in the
Senate and National Assembly, under the Third Remuneration and
Benefits Review Cycle that covers the financial years 2021/2022–
2024/2025. In setting the remuneration and benefits, Salaries and
Remuneration Commission took into account the principles set out in
Article 230 (5) of the Constitution, and section 12 of the Salaries and
Remuneration Commission Act, 2011.
Salaries and Remuneration Commission, being cognizant of the
emerging fiscal constraints and the budget cuts emanating from the
withdrawal of the Finance Bill, 2024, requested the National Treasury
to confirm the availability of funds for the implementation of, inter
alia, the set remuneration and benefits for State officers for the
financial year 2024/2025. In response, the National Treasury, advised
that, due to loss of revenue emanating from withdrawal of the Finance
Bill, 2024 there is no budget allocation for implementation of the set
remuneration and benefits.
Arising from the foregoing, and taking into account the National
Treasury’s advise, and principles set out under Article 230 (5) of the
Constitution, specifically on the need to ensure that the total public
compensation bill is fiscally sustainable, and there being no allocated
budget for implementation of the set remuneration and benefits for
State officers, Salaries and Remuneration Commission amends the
