THAT this application be and is hereby certified as urgent and the same be heard in the first instance ex parte and on a priority basis. 2. THAT a Preservation Order be and is hereby issued for seizure of KSh. 9,578,588.00 held at DTB Bank Limited account number 0931692001 in the name of the 1st Respondent. 3. THAT a preservation be and is hereby issued restraining or prohibiting the Respondent and the Interested Party herein, their agents, employees or otherwise however from selling transferring, disposing off, encumbering, sequestrating or taking possession, interfering with ownership of or otherwise dealing with Motor Vehicle Reg. No. KDL 886J Toyota Hiace to the Agency Director or such other officer the Agency may nominate within seven (7) days of service of this order. 4. THAT an order be and is hereby issued directing the Director General of National Transport and Safety Authority to register acaveat against the records of the motor vehicle Reg. No. KDL 886J Toyota Hiace. 5. THAT an Orders be and is hereby issued authorizing Mr. Martin Samburumo, being an investigator with the Assets Recovery Agency, to seize or take possession of motor vehicle Reg. No. KDL 886J Toyota Hiace and deliver or surrender it to the Agency Director or such officer the Agency may nominate for safe keeping, storage and management. 6. THAT the Preservation Orders shall be for a period of ninety (90) days. 7. THAT the same shall be served upon the Respondent’s within twenty-one (21) days.
