On 5th March. 2003, the Minister for Labour r'eferred thig digpute'
to the Court for consideration and determination. undef powers vested'
in him by section 8 of the Trade Disputes Act, Cap. 234 of the laws of
Kenya (which is hencefonh referred to as the Act); and h'is referdnce,
together with the statutoly certiticates from the Labour Commissioner
and the Minister himself under section 14 (9) (e) and. (J) of the Act,'
wcre received by the Court on 7tli March, 2003. Mwari for the Union
submitted his main memorandum on 22nd May, 1003, and Basilio, the
learned co' unsel for the hospital
, tiled his reply statement thereto on

The parties met again to resolve the matter, and. on 12th
