GAZETTE NOTICE NO. 17539

WHEREAS the defunct County Council of Narok (now Narok County Government), is registered proprietor of all that property known as Cis-Mara/Lemek/160, situated in Narok County and whereas on the 6th March, 2019, a title deed was purportedly issued to (1) Calvin Olonana Kapeen and (2) Maria Rimanto Nyamu and whereas one David Lemomo Kapeen transferred the said parcel to the County Council of Narok in the year 1994, thereby entirely relinquishing his right of ownership over the said parcel and a title deed issued to Narok County Government, which they hold to date and whereas it has been established that both registration and the title deed held by to (1) Calvin Olonana Kapeen and (2) Maria Rimanto Nyamu was procured through misrepresentation and falsification of facts in total disregard of the existence of another valid title deed and whereas sufficient evidence has ben adduced to prove that the said title deed was fraudulently acquired and whereas all efforts made to compel (1) Calvin Olonana Kapeen and (2) Maria Rimanto Nyamu to surrender the said title deed and all the efforts to have the title deed surrendered for cancellation under section 14 (a) , (b) and section 79 (2) of the Act and regulations thereof have been futile and whereas notice is given that I intend to dispense with the production of the said land title deed and proceed to reinstate the title deed held by the Narok County Government, the bonafide owner, and upon such reversion the land title deed issued earlier to (1) Calvin Olonana Kapeen and (2) Maria Rimanto Nyamu, shall be deemed to be cancelled and of no legal effect provided that no objection has been received .
