LADY JUSTICE L. M. NJUGUNA ORDER THIS MATTER coming up for directions before Hon. Lady Justice L. M. Njuguna on the 5th of February, 2025. And upon reading the application dated the 4th February, 2025 brought under certificate of Urgency by the Counsel for Applicant under sections 81 and 82 of the Proceeds of Crime and Anti-Money Laundering Act and Order 51 rule 1 of the Civil Procedure Rules, and upon perusal of the supporting affidavit of Jackson Kimani annextures thereto; IT IS HEREBY ORDERED: That a preservation order be and is hereby issued restraining the Respondent and or/his employees, agents, or representatives acting on his behalf from selling, transferring, disposing off or in any manner dealing with the motor vehicle registration No. KCZ 723D and chassis No. E11-631838. That a preservation order be and is hereby issued restraining the Respondent and or/his employees, agents, or representatives acting on his behalf from selling, transferring, disposing off or in any manner dealing with unregistered parcel of land falling within the mainland South registration Block parcel No. MS/III/203 identified by geographical co-ordinates -4.1059696, 39.6461961 and all the developments thereon. That the Respondent be and is hereby directed to surrender the motor vehicle ,original logbook and ignition keys of the motor vehicle specified in order 1 above to the Applicant within 7 days from the date of service. That an order be and is hereby issued directing the Director General of National Transport and Safety Authority to register caveat against the records of the motor vehicle specified in order 1 above. That in the event the Respondent fail to deliver the motor vehicle subject of order 1 above,an oreder be and is hereby issued authorizing Jackson Kimani, the investigating officer herein, to take possession of the motor vehicle and deliver or surrender it to the Applicant’s Director or such other officer dully appointed by the Applicant’s director.
