GAZETTE NOTICE NO. 1167

WHEREAS, Nyamira County is blessed with natural minerals such as Kaolin, White Clay, Murram and Concrete stones; WHEREAS, the Mining Act 2016 distributes the royalties from mining activities to benefit the national government (70%), the county government (20%) and the community (10%) for the purpose of spurring development, this has hardly been actualized. WHEREAS, it is the responsibility of the County Government to ensure that Natural Resources are exploited to profit the local community and government in a safe and sustainable manner. WHEREAS, it has been noted that these natural resources are being exploited by unauthorized private individuals in an un- structured manner that has led to undue exploitation of the local citizens who own land, loss of job opportunities, loss of revenue due to the County Government and lack of safety guarantees to the people of Nyamira; WHEREAS, the State Department of Mining noted illegal Mining of Kaolin in Kiabiraa, Manga Sub County and thereby ordered the suspension of Kaolin mining in the area vide letter Ref.No. MIG/5567/06 dated 22nd October, 2024 by the Regional Mining Officer Migori until such a time when the provisions of the Mining Act, CAP 306 are fully adhered to; AND WHEREAS, the National Environment Management Authority (NEMA) vide letter Ref: NEMA/5/11/vol.11 dated 8th March, 2023 suspended quarrying activities at Kiabiraa, Manga Sub County over Environmental and Health risks and has since not been adhered to by those mining. NOW THEREFORE, in exercise of the powers conferred by the Fourth Schedule, Part 2 of the Constitution of Kenya, 2010 as read together with Section 30 of the County Government Act (No. 17 of 2012), Gazzette Notice No. 16472 of 2024 and all other enabling laws; I, Amos Kimwomi Nyaribo, Governor of Nyamira County, do hereby ORDER and DIRECT; - 1. THAT, there be a Temporal Cessation of all Kaolin Mining activities until further notice, to allow the National Government and County Government fully streamline Kaolin Mining activities. 2. THAT, all Kaolin permits issued earlier by the County Government of Nyamira are hereby cancelled and/or revoked. 3. THAT, persons interested in exploiting Kaolin are advised to apply for fresh mining permits upon compliance with the Legal Requirements spelt out in the Mining Act, 2016, Environmental Management and Coordination Act, 1999 and all other relevant laws 4. THAT, the County Government Enforcement Officers in collaboration with the National Government Agencies do enforce this Executive Order. Dated the 31st January, 2025.
