THE LAND REGISTRATION ACT

REGISTRATION

WHEREAS The Coast Development Company Limited, of P.O. Box 43998, Nairobi in the Republic of Kenya, is registered as proprietor in fee simple of all that parcel of land, known as L.R. No. 5046/10–Kilifi, situate in the west of Kilifi Town in the Kilifi District, registered in Mombasa land registry and whereas in the Senior Principal Magistrate’s court at Kilifi has issued Court order from Misc. ELC E3 of 2023 (O.S) vesting the plot in adverse possession in favour of (1) David Munene Mwithalie and (2) Harman Kaindi Pishi, and whereas the land register in respect thereof is lost or destroyed and efforts made to locate the said land register have failed, and whereas (1) David Munene Mwithalie and (2) Harman Kaindi Pishi have executed a deed of indemnity in favour of the Government of the Republic of Kenya, notice is given that at the expiration of fourteen (14) days from the date hereof provided no valid objection has been received within the period, I intend to proceed with the reconstruction of the said file as provided under section 33(3) of the Act.
