THE JUDICIAL SERVICE ACT

APPOINTMENT
PURSUANT to section 30 of the Judicial Service Act and section
3 Part II of the First Schedule, of the Judicial Service Act, 2011, I,
Martha Karambu Koome, Chief Justice of the Republic of Kenya, for
and on behalf of the Judiciary of Kenya, declare vacancies in the
Office of Judge of the Environment and Land Court of the Republic of
Kenya.

Job title: Judge of the Environment and Land Court
Number of posts: Ten (10) posts
Tenure of office: Retirement at the age of seventy (70) years with
the option for early retirement after attaining the
age of sixty–five (65) years in accordance with
Article 167 (1) of the Constitution.
Remuneration and Benefits:
Based on guidelines by the Salaries and Remuneration Commission of
Kenya, gross monthly remuneration package excluding benefits is
minimum of KSh. 750,000 and a maximum of KSh. 1,029,691
Functions of the Judge of the Environment and Land Court:
A Judge of the Environment and Land Court shall serve in any
Environment and Land Court station for under Article 162 (2) (b) of
the Constitution as read with Part III of the Environment and Land
Court Act, Cap. 80, namely—

(a) Original and appellate jurisdiction to hear and determine all
disputes relating to environment and the use and occupation
of, and title to, land;
(b) Hear and determine disputes relating to:
(i) environmental planning and protection, climate issues, land
use planning, title, tenure, boundaries, rates, rents,
valuations, mining, minerals and other natural resources;
(ii) compulsory acquisition of land;
(iii) land administration and management;
(iv) public, private and community land and contracts, choses in
action or other instruments granting any enforceable
interest in land; and
(v) any other dispute relating to environment and land.
(c) Hear and determine applications for redress of a denial,
violation or infringement of, or threat to, rights or
fundamental freedom relating to a clean and healthy
environment under Articles 42, 69 and 70 of the Constitution.
(d) Exercise appellate jurisdiction over the decisions of
subordinate courts or local tribunals in respect of matters
falling within the jurisdiction of the court.
Constitutional and Statutory Requirements for Appointment:
For appointment to the position of Judge of the High Court, the
applicant must possess the following minimum qualifications set out in
Article 166 (2) (a), (b) and (c) of the Constitution as read with Section
7 of the Environment and Land Court Act, namely:
1. Hold a law degree from a recognized university, or be an
advocate of the High Court of Kenya, or possess an equivalent
qualification in a Common-law jurisdiction;
2. (a) Have at least ten (10) years’ experience as a superior court
judge or a professionally qualified magistrate;
or
(b) Have at least ten (10) years’ experience as a distinguished
academic, or legal practitioner or such experience in other
relevant legal field;
or
(c) Have held the qualifications specified in paragraphs 2 (a) and
(b) above for a period amounting, in the aggregate, to ten (10)
years; and
(d) Possess the experience required under paragraph 2 (a),(b) and
(c) above as applicable, irrespective of whether that experience
was gained in Kenya or in another Commonwealth Common-
Law jurisdiction; and
3. Have a high moral character, integrity and impartiality (meet
the requirements of Chapter Six of the Constitution on Leadership and
Integrity).
Notes:
(i) Experience gained in Kenya or in another Commonwealth
Country with a common law jurisdiction will be considered;
(ii) Knowledge and experience in environmental and matters will
be an added advantage.
In addition, the applicants should demonstrate a high degree of
professional competence, communication skills, fairness, good
temperament, good judgment, wide breath of both legal and life
experience and demonstrable commitment to public and community
service.
The appointments shall be made in accordance with Article 166 (1)
(b) as read with Article 162 (2) (b) and (3) of the Constitution of
Kenya, 2010 and section 30 and the First Schedule of the Judicial
Service Act, 2011 and section 7 of the Environment and Land Court
Act.
