PURSUANT to Section 59 of the Environmental Management and Coordination Act CAP 387, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Maf Hazfree Solution Limited, proposes to establish an Integrated Waste Handling Facility as well as auxiliary infrastructure. The facility layout will integrate administrative, operational, treatment, and disposal components (Site offices / administrative block, solid waste, chemical waste handling/treatment, crushing and neutralization pits, asbestos burial as well as medical waste incinerator sections),other associated facilities and amenities on Parcel No, 2182 (2182A), Kalumani Mwenyenzeni Adjudication Section, Kaloleni Sub-County, Kilifi County.. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Change in land use • Apply and obtain a change of user from the County Government of Kilifi. Potential conflicts with the local community • Develop and implement a Grievances Redress Mechanism (GRM) for conflict resolution. Biodiversity loss • Landscaping after completion of project • Tree planting within and around the project site (indigenous tree species are advised). Land degradation • Rehabilitate shallow gullies within the project site to prevent further erosion. • Restrict excavation to only the areas required for facility infrastructure and access roads. • Store excavated topsoil separately in protected stockpiles for reuse in backfilling. Environmental risks of obtaining raw materials • Source raw materials from sites that are licensed as per the Environmental Management and Coordination Act Cap 387 of the Laws of Kenya. • Procure quantities of construction materials in line with the Bill of Quantities prepared by a Licensed Quantity Surveyor to reduce wastage. • Re-use construction materials such as steel and wood cuttings which can be recovered. Health and safety risks • Register the site as a workplace with the Directorate of Occupational Safety and Health Services (DOSHS). • Construction works, installations and supervision should be carried out by registered contractors and engineers/architects. • Obtain insurance cover for the workers as per Work Injury Benefit Act (WIBA), 2007. • Provide appropriate PPE for all workers and visitors to the facility, including gloves, respirators, goggles, chemical-resistant boots, asbestos suits, and protective clothing for handling hazardous or infectious waste and enforce their use. • Provide workers with correct tools for jobs. • assigned and train on their use. • Ensure moving parts of machines and sharp surfaces are securely protected with guards to avoid unnecessary contacts and injuries. • All accidents should be reported, investigated and corrective action taken to prevent reoccurrence. • Develop and implement an emergency response plan for exposure to hazardous waste (asbestos, chemicals, medical waste) incidents, fire, or injuries. 30th January, 2026 THE KENYA GAZETTE Impacts Mitigation Measures • Install emergency safety facilities, such as eyewash stations, emergency showers, and first aid kits, strategically around the facility. • Provide regular health check-ups for workers exposed to noise, dust, chemicals, or asbestos. • Limit access to hazardous areas and use signage to warn on asbestos, chemical hazards, and high noise zones. • Sensitize workers to report unsafe conditions and near-misses to continuously improve workplace safety. • Comply with the provisions of Occupational Safety and Health Act (OSHA), 2007. Fire hazards and emergencies • Develop and implement emergency response plan for fires, explosions, or chemical-related incidents. • Store flammable chemicals and waste oil in designated, roofed, and bunded areas away from ignition sources. • Provide adequate fire detection and suppression systems, including fire extinguishers, sprinklers, and fire blankets near storage and handling areas. • Train workers in fire prevention, emergency response, and safe handling of flammable chemicals. • Regularly inspect tanks, pipelines, and storage areas for leaks, corrosion, or structural weaknesses that could trigger fires. • Regularly inspect tanks, pipelines, and storage areas for leaks, corrosion, or structural weaknesses that could trigger fires. • Segregate incompatible chemicals to prevent reactive hazards. Air pollution • Sprinkle water on the unpaved access road at least twice daily to suppress dust • Pave internal roads to reduce dust generation. • Ensure timely offloading and sorting to prevent waste accumulation and decomposition on-site. • Cover waste trucks entering and leaving the facility to reduce odor. • Conduct routine maintenance of vehicles and machinery to reduce exhaust emissions. • Store chemicals and waste oils in closed, well ventilated rooms with tight-fitting lids on all containers. • Maintain incinerators in optimal working condition (calibration, proper loading rates, adequate residence time) to minimize emissions. • Install pollution control devices on incinerators (scrubbers, filters) to reduce particulate and gas emissions. • Provide PPE for workers, including dust masks and respirators, especially in high- exposure sections. Impacts Mitigation Measures • Provide sealed containers for organic, hazardous, and medical waste to minimize odor escape. • Monitor ambient air quality quarterly to track. • Comply with the provisions of the Environmental Management and Coordination (Air Quality), Regulations, 2024. Noise pollution • Procure and provide adequate ear muffs to workers at peak noise producing areas. • Delivery of raw materials, installation and fabrication works should be limited to day time hours only between 8am to 5pm. • Service vehicles, generators, and equipment regularly to minimize excess noise. • Conduct noise levels monitoring. • Comply with the provisions of the Environmental Management and Coordination (Noise and Excessive Vibration Pollution) (Control) Regulations, Liquid waste generation • Install properly designed drainage system to channel stormwater away from waste handling areas. • Construct lined leachate collection systems around waste reception, sorting, and storage areas to prevent seepage into soil. • Designate and pave wash-down areas with controlled drainage leading to an oil interceptor before discharge. • Regularly inspect and maintain drainage channels, and containment structures to ensure they function effectively. • Train and sensitize workers on proper handling of wastewater, chemicals, and sanitation facilities, emphasizing prevention of leaks and improper disposal. • Apply for and obtain EDL from NEMA. • Monitor wastewater from the facility. • Comply with the provisions of the Environmental Management and Coordination. Ash and residue generation • Collect incinerator ash regularly and store it in lined, covered, and labeled containers to prevent dispersion and contact with workers or the environment. • Dispose of ash in lined pits to prevent soil and water contamination. • Train workers on safe handling, transport, and disposal of incinerator ash. Increased water use • Install water-efficient fixtures in all sanitation and staff facilities. • Harvest and store rainwater to supplement non-potable water needs and reduce pressure on the borehole. • Install leak-detection systems and conduct routine inspections to promptly identify and repair leaks in pipes, tanks, and fittings. • Sensitize staff on water conservation practices and enforce responsible water-use. • Keep water consumption records. 354 354 Impacts Mitigation Measures Increased energy use • Procure energy-efficient equipment for waste • handling, lighting, and office operations. • Use renewable energy sources where feasible, such as solar panels for lighting or auxiliary power. • Install smart meters to monitor electricity usage. • Create awareness among employees on energy conservation such as switching off lights when not in use. • Conduct energy audits at least once every three years and implement the recommendations. • Comply with the Energy Act, 2019. Contamination of soil and water resources • Construct a concrete paved area to be used for clean-up activities. • Waste water from the clean-up area should be directed towards the established water drains. • Install bunded and impervious containment areas around chemical tanks, waste oil tanks, and neutralization/crushing pits to capture spills and leaks. • Install a leachate collection and drainage system to capture contaminated runoff and direct it to the bio-digester. • Regularly monitor soil and water resources (borehole and water pan). Labor influx and social concerns • Prepare a site-specific Labor Influx Management Plan and implementation framework prior to project commencement. • Implement measures to prevent, identify, address, and resolve conflicts before and when they occur including SEAH at the workplace including anonymous reporting systems. • Develop and implement a Grievances Redress Mechanism (GRM) for conflict resolution. Climate change risks • Prepare annual carbon footprint reports and implement the recommendations.
