GAZETTE NOTICE NO. 1667

PURSUANT to section 59 of the Environmental Management and Co-ordination Act, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Mingland Company Limited, proposes to construct a 25No. storey residential apartments comprising of 2-level basement for parking, 294no.(four, three and two bedrooms residential apartments), water supply connection, power supply intergration, back-up generators, fire detection and suppression systems, telecommunications provisions associated facilities and amenities on L.R.No. Nairobi/Block 17/283, Kilungu Road, in Kilimani, Nairobi County. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Waste management (Construction wastes)  Waste materials will be segregated on- site into appropriate skips/containers and removed from site by suitably permitted waste contractors to authorized waste facilities/landfills.  Where possible, reusable waste materials will be reused on-site to minimize raw material consumption.  Excavated of ground and subsoil will be removed for offsite reuse, recovery, recycling and/or appropriate disposal by licensed handlers.  Leftover materials (e.g. timber off-cuts, broken concrete blocks/bricks) and any suitable construction materials shall be re-used on-site, where possible. Impacts Mitigation Measures  Any hazardous waste generated such as (chemicals, solvents, glues, fuels, oils) will be segregated and stored in appropriate receptacles (in suitably banded areas, where required.  All construction staff will be provided with training regarding waste management and handling procedures. Noise and vibration  Construction working hours will be restricted to daytime.  Vehicles and machinery will be maintained in good and effective working order and operated in a manner to minimize noise emissions.  The compressors, generator and engine compartment doors will be kept closed and machinery turned off when not in use.  All pneumatic tools will be fitted with silencers/mufflers.  The use of noisy equipment will be limited, i.e. avoiding the use of noisy plant/machineries early in the morning.  Drop heights will be minimized when loading vehicles with rubble.  Ensure hoarding, screens or barriers are erected to shield noisy activities.  The contractor will ensure that all plant/machineries comply with the relevant statutory requirements.  Occupiers of adjacent properties will be informed by the Contractor up to 2 weeks in advance of the planned works, including the duration and likely noise and vibration effect. Air quality (Increased atmospheric particle concentrations)  Water misting, or sprays shall be used as required if particularly dusty activities are necessary during dry or windy periods.  The contractor will regularly inspect, test and maintain all the safety equipment (including scaffolds, guardrails, working platforms, hoists, ladders and other means of access, lifting equipment etc.  Workers will be provided (before they commence work) with appropriate PPEs suitable for each work/activity such as safety boots, helmets, gloves, protective clothes, goggles, and ear protection.  The contractor shall adhere to the Occupational Health and Safety Act 2007 and Employment Act, Cap. 226. Drainage and flooding  The contractor shall ensure that construction materials, debris, or waste do not obstruct existing drainage channels within the project corridor.  The project engineer will conduct routine monitoring of drainage channels to ensure they remain clear of waste and debris throughout the construction period.  Stormwater shall be directed into designated drainage channels, ensuring that it does not flow onto or impact adjacent properties. 462 462 Impacts Mitigation Measures Social impacts (privacy issues)  The contractor shall implement a non- discriminatory hiring and wage policy, ensuring that employment and compensation decisions are free from bias based on gender, age, religion, ethnicity, or place of origin.  The contractor will enforce a strict zero- tolerance policy on sexual harassment in the workplace, ensuring a safe and respectful working environment.  An accessible grievance mechanism shall be established and communicated to Project Affected Persons (PAPs) to address complaints. Generation of solid waste  The proponent will abide by the Nairobi County (Solid Waste Management Act, 2015) and Environmental Management and Coordination Act (Waste Management) Regulation 2024 in managing and disposing solid waste from the facility.  The proponent shall provide different colored bins for different categories of waste and ensure complete segregation of biodegradable and non- biodegradable wastes.  Spent oil from the backup Diesel Generator (DG) sets should be stored in HDPE drums in isolated covered facility and disposed off as per the Hazardous Wastes regulations. Increased energy use  The project proponent should provide guidelines to the users to ensure conservation of energy.  Use of energy efficient electrical systems should be promoted and encouraged. High efficiency lamps with electronic ballast should be used.  The power cabling shall be adequately sized to maintain the distribution losses not to exceed 1% of the total power usage.  The project proponent should incorporate solar energy in water heating systems and outdoor lighting.  Use of energy efficient lighting systems e.g. High-Pressure Sodium Vapour (HPSV) Lamps, LED etc. shall be used and promoted. Increased water supply and demand  Water requirements during operation phase shall be met by Nairobi City Water and Sewerage Company (NCWSCo). The erratic supply from NCWSCo. Shall also be supplemented with ground water sources (borehole) if practically possible.  Use of water meter conforming to Kenya water usage standards (Water Quality) Regulations, 2024) should be installed at the inlet point of water uptake to monitor the daily water consumption.  Use of water saving fixtures in common areas e.g. sensor taps, high pressure low volume cisterns.  The proponent must promote and practice rainwater harvesting on a regular basis to reduce pressure on water demand. Impacts Mitigation Measures Occupational safety  Firefighting systems should be designed in compliance with the Factories & Other Places of Work (Fire Risk Reduction) Rules, 2007.  All hydrant outlets should be provided with protective caps to help prevent vandalism.  Unprotected and bare electrical cabling/wiring that is exposed to water or contact with flammable materials will be discouraged.  Training and awareness programmes will be rolled out at household level, with a focus to:-  Ensure awareness on the use of single sockets/fuses for electrical equipment;  Fire alarms should be placed on every floor of each unit;  Conduct periodic assessments such as. Electrical inspection, fire safety audits from time to time to ensure occupational safety. Effluent discharge (sewerage and wastewater)  All wastewater and sewerage will be channeled into the existing sewerage system provided by NCWSCo.  The proponent is encouraged to adopt green building technology incorporating techniques like treating and recycling wastewater to prevent overload of the existing sewer trunk.
