GAZETTE NOTICE NO. 4446

PURSUANT to section 59 of the Environmental Management and Coordination Act, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Starehe Point Apartments Limited, proposes to construct 23No. Blocks (2No. market units blocks, 15No. affordable housing units blocks and 6No. social housing units blocks) of 13 storey each, comprising a total of 4096 housing units of one, two and three bedroom units (1062 social housing units, 2634 affordable housing units and 400 market housing units), swimming pool, community Centre, club house, parking silos, other associated facilities and amenities on plot L.r Nos. 209/20158 and 209/20159 in Starehe Sub-county, Nairobi County. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Housing of construction workers • Use of local labor force as far practical to avoid setting up a labor camp. Construction material extraction and use • Availability and sustainability of the materials extraction sites as they are nonrenewable in the short term. • Source building materials from certified suppliers. Safety & integrity of building during construction • Comply with the National Construction Authority Act, No. 41 of 2011. • Comply with applicable Labor Laws e, g. the Occupational Safety and Health Act, 2007; the Work Injury Benefits Act, 2007. • Use of appropriate construction materials and reinforcements as per specifications. • Close supervision of construction works. • Proper supervision and material testing regime. Increased traffic flow & road safety concerns during construction • Implement a traffic management plan for the proposed development. • Erect appropriate road safety signage. • Deploying of adequate traffic marshals. 27th March, 2026 THE KENYA GAZETTE Impacts Mitigation Measures • Provide adequate construction parking allocation within the project site. Site excavation leading to site disturbance • Flora and Fauna disturbance-minimize disturbance of areas with important flora, implement an appropriate re- vegetation programmed to restore disturbed areas to its original status & institute mechanisms for upcycling within the project. • Damaged to utility and pipe-consult Nairobi City County (NCC), NCWSC, KPLC and Telkom Kenya Limited on the presence of pipes & utility cables. • Fall accidents and caving in of excavations leading to injury or death- appoint safety supervisor and stabilize excavations to prevent caving in; • Excavate only areas to be affected by buildings. • Dumping of excavated materials to sites approved by NEMA and the county government. • Landscaping and restoration of excavated sites. Noise pollution and excessive vibration • Carryout regular monitoring of noise levels. • Comply with EMCA Noise Pollution & Excessive Vibration Regulations, 2009. • Ensure use of earmuffs and earplugs by machine operators and workers in noisy areas. • All workers shall be trained and provided with PPEs such as helmets, earmuffs, dust mask, etc. which will always be used when operating within the site area. • Safety signage shall be erected at the construction site entrance to notify of the construction activities and timings. Air pollution, particulate matter and dust emission • Cover all trucks hauling soil, sand and other loose materials to the outside of the site. • Ensure no burning of waste such as paper and plastic containers on the construction site. • All workers at the construction site and visitors exposed to dusty conditions must be provided with dust masks and other PPEs. • Raw materials where possible must be sourced as close as possible to the construction site thus reducing the emissions from vehicular traffic. • Regular and prompt maintenance of construction machinery and equipment to minimize generation of hazardous gases. • Institute appropriate dust suppression measures such as regular sprinkling of water on dusty access roads; speed limits; etc. Occupational safety & health • Register the construction site with Department of Occupational Safety and Health Services (DOSHS). Impacts Mitigation Measures • Comply with applicable Labour Laws e,g. the Occupational Safety and Health Act, 2007; the Work Injury Benefits Act, 2007, etc. • Staff awareness creation on safety and health issues. • Have trained First Aiders and fully equipped First Aid box on site. • Provide and ensure proper use of personal protective equipment i.e. safety boots, helmet, goggles, and hand gloves. • Proper supervision of works. Public safety & health • Comply with applicable Labour Laws e,g. the Occupational Safety and Health Act, 2007; the Work Injury Benefits Act, 2007. • Hoarding / fencing of the construction site to prevent unauthorized people accessing the site. • Enforce speed limits for trucks and vehicles delivering construction materials. • Proper signage and warning to public of heavy vehicle turning. • The contractor to abide by ESIA licensing conditions. Solid waste generation • Comply with EMCA Waste Management Regulations 2006. • Ensure re-use of materials that can be re- used. • Use of the 3rs – Reduce, Re-use, Re- cycle. • Efficient use of building material to reduce waste and recycling/reuse where feasible. • Provision for waste management receptacles/bins at strategic places within the site. • Segregation of waste at the source during the project cycle. • Use of an Integrated Solid Waste Management System (ISWMS); through a hierarchy of options: source reduction, recycling, composting and reuse, will facilitate waste handling during operation/occupation phase.
