PURSUANT to sections 101 (1) (a) and (c) and 102 (1) (2) and (3) (a), after inquiriring into the mater of failure on the part of the licencee to give adequate services as required, Water Services Regulatory Board (WASREB) in consultation with the Mombasa County Executive Committee imposes a special regulatory regime on Mombasa Water Supply and Sanitation Company (MOWASCO), a water service provider (WSP) licenced by the Water Services Regulatory Board (WASREB) to provide water and sewerage services to residents of Mombasa within Mombasa County as delineated in the licence. The special regulatory regime shall remain in force for six (6) months from the date of this publication in order to— (a) Safeguard the progressive realization of the right to water to the consumers within the service area designated for this WSP within Mombasa County. (b) Address poor governance and management malpractices of the water service provider. (c) Improve internal control functions and financial management of the water service provider; and (d) Improve the sustainability of the water service provider. During this time, the special regulatory regime measures shall include, but not be limited to- (a) The WSP shall submit a weekly income and expenditure report to WASREB. (b) The WSP shall submit bank reconciliation statements to WASREB on a monthly basis. (c) The WSP shall submit an operation and maintenance report monthly using the reporting template to be issued by WASREB. (d) The WSP shall submit Water quality reports on a monthly basis. (e) The WSP shall submit a monthly progress report on progress made in addressing issues raised in the WASREB inspection report. (f) All board committees, board meetings, or ad hoc board meetings shall be attended by WASREB. The special regulatory regime takes effect from the date of this publication.
