THE LAND REGISTRATION ACT

REGISTRATION

WHEREAS James Mbithi Malombe alias Mbithi Malombe (deceased), is registered as proprietor of all those pieces of land containing 3.8 and 0.9 hectares or thereabout, situate in the district of Kitui, known as Matinyani/Mutulu/296 and 1090, respectively, and whereas in the Chief Magistrate’s Court at Kitui in Succession Cause No. 9 of 2020, has issued grant of letters of administration and certificate of confirmation of grant in favour of Julius Mwova Mbithi, and whereas the said Julius Mwova Mbithi, has executed land application to be registered as proprietors by transmission L.R.A. 39, and whereas the said land title deed issued earlier to the said James Mbithi Malombe alias Mbithi Malombe (deceased), has been reported missing or lost, notice is given that after the expiration of thirty (30) days from the date hereof, provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said L.R.A. 39 and upon such registration the land title deed issued earlier to the said James Mbithi Malombe alias Mbithi Malombe (deceased), shall be deemed to be cancelled and of no effect.
