WHEREAS Karisa Kalu Birya, of P.O. Box 117, Watamu in the Republid of Kenya, is registered as proprietor of that piece of land known as parcel No. Gede/Kirepwe "B"/12, situate in Watamu, Malindi District, and whereas the principal magistrate's court at Malindi, in civil case No. 1 of 2007, has ordered that the said piece of land be subdivided and a portion be transferred to Cosmas Charo Katana, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from tile date hereof provided that no 1st February, 2008 THE KENYA GAZETTE 191 valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with registration of the said instrument of subdivision and transfer and issue a land title deed to the said Cosmas Charo,Katana, and upon such registration the land title deed issued earlier to the said Karisa Kalu Birya, shall be deemed to be cancelled and of no effect.
