WHEREAS Nowa Ogada Rading, is registered proprietor of that piece of land known as Gcm/Marenyo/1494, situate in the district of Siaya, and whereas the senior resident magistrates court at Siaya, in case No. 33 of 2007, has ordered the said piece of land to be subdivided as per court order, and whereas the executive officer of the said court has in pursuance to an order of the said court executed a subdivision of the said piece of land and a portion transferred in favour of the said Jared Aincah Ngutu, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof, provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with the registration of the said instrument of subdivision and transfer and issue a land title deed to the said Jared Aincah Ngutu, and upon such registration, the land title deed issued earlier to the said Nowa Ogada Rading, shall he deemed to he cancelled and of no effect.
