OF KENYA THE LOCAL GOVERNMENT ACT (Cap. 265) THE LOCAL GOVERNMENT ELECTIONS RULES ELECTION OF COUNCILLORS IN EXERCISE of the powers conferred by section 42A of the Constitution of Kenya, section 57 of the Local Government Act and rule 12 of the Local Government Elections Rules, the Electoral Commission gives notice that: (a)An election is to be held to determine the councillor to serve in each of the electoral areas (wards) of the respective local authority as set out in the Schedule hereunder. (b)Each political party wishing to participate in the election must finalize the nomination of its candidates on or before 24th May, 2008. (c)The days for the nomination of the candidates for the councillors will be on 26th and 27th May, 2008 and the nomination papers, which may be collected from the Returning Officer in whose jurisdiction the electoral area falls, may be delivered by the candidates to the Returning Officer concerned at between the hours of eight o'clock in the morning and one o'clock in the afternoon and between the houri of two o'clock and four o'clock in the afternoon of the days. (d)In respect of Kalaliyo Central civic ward in Mandera East constituency the only candidates to contest the by-election will be (1) ROBLE GEDI JILLOW of Forum the Restoration of Democracy for the People political party and (2) HUSSEIN SHEIKH ,MOHAMED of Kenya African National Union political party who tied during the General Election held on 27th December, 2007. (e)In all electoral areas or civic wards where the elections held during the General Election on 27th December, 2007 was countermanded or avoided or cancelled or called off on account of a defect on the ballot paper or the occurrence of the death of a duly nominated candidate prior to the announcement of the election results, candidates who had been duly nominated unless a candidate indicates in writing to, the Returning Officer that he or she is not contesting the by-election or the political party which sponsored or nominated such a candidate duly withdraws its said sponsorihip or nomination and the candidate fails to secure sponsorship or nomination from any other registered political party.
