GAZETTE NOTICE NO. 3948

IT IS notified for general public information, that pursuant to section 17 of the Seeds and Plants Varieties Act, and Regulation 16 of the Seeds and Plants Varieties (Plant Breeder‘s Right‘s) Regulations, the Minister for Agriculture, gives notification of applications for grant of Plant Breeders‘ Rights for the 63 plant varieties specified hereunder. The person entitled to make representations regarding any application is either the breeder or successor in title to the breeder or any person having substantial interest or is in a position to adduce material evidence as to the grant. The presentations may be made by lodging the original or certified copy of the deed of assignment; or lodging the original or certified copy of letters of administration of the grant or such documentary evidence as will satisfy the authorized officer. The presentations or requests for a hearing concerning the applications or any matters on which the authorized officer should be satisfied shall be made by the person applying for the opportunity to make representations. THE KENYA GAZETTE 15th April, 2011 The representations and or requests for a hearing concerning the application should be made in accordance with regulation 17 of the Seeds and Plant Varieties (Plant Breeder‘s Rights) Regulations. The application for the opportunity to make representation shall be made to the Authorized officer who is also the Managing Director, Kenya Plant Health Inspectorate Service, P. O. Box 49592, Nairobi. The application for opportunity to make representations shall be made within sixty (60) days from the date of publication of this notice in the Kenya Gazette.
