GAZETTE NOTICE NO. 9233

IN EXERCISE of the powers conferred by Section 41A of the former Constitution of Kenya, section 13 of the National Assembly and Presidential Elections Act and regulations 8 (3), regulation 14 of the Presidential and Parliamentary Elections Regulations and pursuant to the Court of Appeal–Civil Application No. NAI.130 of 2011 (UR.85/2011) Ruling issued on 29th July, 2011, lifting the suspension to conduct the Kamukunji By-election, the Interim Independent Electoral Commission gives notice that: (a) An election is to be held of a member to serve in the National Assembly for Kamukunji Constituency. (b) Gazette Notice Nos. 2315, 2316, 5123 and 5124 of 2011 remain valid except for the polling day. (c) The Ballot Papers as prepared under Regulation 28 1 (b) of the Presidential and Parliamentary Elections Regulations for Kamukunji Constituency remain valid. (d) All political party candidates who qualified to participate in the by-elections following the nominations held on 27th April, 2011 and 28th April, 2011, stand validly nominated and may carry out campaigns for the extended period provided. (e) The Campaign period will commence from 3rd August, 2011, and shall cease twenty-four hours before start of polling on 16th August, 2011. (f) The poll will take place on the 18th August, 2011. NOTES: 1. The attention of candidates and persons subscribing nomination papers is drawn to the provision of Part IV of the Presidential and Parliamentary Elections Regulations (Cap.7. Sub. Leg.) 2. A person guilty of an election offence will be liable to the penalties imposed by the Election Offences Act (Cap. 66) and to the disqualifications imposed by the National Assembly and Presidential Elections Act (Cap.7).
