GAZETTE NOTICE NO. 12284

PURSUANT to regulation 21 of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed shancliff apartments. The proposed project entails construction of eight (8) identical blocks of apartments each with thirteen (13) floors, totaling to 624 apartments. The proposed project site is on land registered as MN/1/4875 and MN/1/4876 precisely located in Shanzu area near the Wildlife Clubs of Kenya Offices and YAMAS club. This site is within Shanzu location which is administratively located in Bamburi division of Kisauni district, Mombasa County. The following are the anticipated impacts and proposed mitigation measures: Environmental issue Mitigation Measures Site clearance/earth moving Let clearance of the site be done selectively taking into consideration valuable plant forms on site Tree forms with historical/cultural element will be preserved/conserved at some points within the same premises. Work the earth movers gently with consideration on dust emissions In some of the places quite dry, sprinkle water to reduce dust emissions Soils in excess should be set aside during the same clearance on the site Dust emissions/fumes If possible undertake initial construction activities during the dry season to prevent water/soil run-off especially on side slopes. Water should also be diverted away from the project footprint areas through properly constructed drainage channels Ensure that spills emanating from construction plant and equipment are cleaned immediately. Any petroleum products stored on site must be stored in bunded areas to prevent contamination of surface water. Contractor to adhere to Construction HSE management plan during the construction phase. Loss of biodiversity. Engage a botanist to assess the plant life of the project site with a view to identifying the endangered and endemic plants as per the IUCN red list; Retain any of the trees that have a cultural connotation or have an endemic element like the baobab tree; Do not use any chemicals in the form of herbicides during the clearance of vegetation; Revegetate the project site in a major beautification programme. Occupational health and safety Signage should be made available alerting of possible danger situations; Ensure first aid kits are well stocked and workers trained in first aid as well; Provide personal protective equipment (PPE). Provide for adequate and gender sensitive sanitary facilities Emergency measures such as ambulance in case of any incident or accident. Provision of workman‘s insurance cover. Solid waste generation All excess soils mixed in various twigs of cleared vegetation should be loaded into trucks for disposal at designated dumping sites duly recognized by NEMA and the municipal council of Mombasa. Reuse and recycle some of the packaging materials left out as waste such as cartons, cement bags, metal bars, plastic bags e.t.c. Provision of waste collection bins at some designated points within the premises. Increased frequency of collection by the contracted waste collection agency incase waste increases in generation. No excess soils should reach the ocean in whatever ways. Noise and excessive vibrations Restrict excessively noisy operations between 8am and 5pm and inform neighbors and workers about the schedule. Sample out construction activities notoriously known to be noisy such as laying of slab which could extend to cover 24 hours and notify neighbors of the actual day when the activity could be held in advance. Ensure all equipment is put under strict maintenance programme that will take heed to noisy levels. Operationalize an OHS programme as spelt out in chapter seven. Cliff conservation Ensure all civil works greatly avoid the cliff for fear of degrading it. There should be no construction within a set perimeter near the cliff. (The length to be determined by architect but suggested could be 30 feet). Avoidance of un necessary shocks to sub surface rocks during excavation. Erect a barrier for safety purposes to both the guests/tenants/workers made of iron bars. Soil and water pollution All sources of pollution like oil spills should be identified and containment procedures shared with all workers. Drainage channels should be well constructed as to ensure all waste water drains into them to the treatment works. Samples of polluted water will be taken for analysis in a NEMA accredited laboratory and results to form part of the advisory plan for the establishment. Soil erosion Ensure earth moving activities do not trigger the movement of soils to the sea by avoiding the areas quite close to the sea. Ensure compacted areas are ripped to reduce surface run off. Any activities involving the disturbance of the soil must be under strict supervision to avoid soils from being pushed into the sea. A proper drainage structure that ensure no water drains into the sea is installed.
