PURSUANT to regulation 21 of Environm ental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the construction of the proposed 300 holiday apartments. The project will involve construction of 300 multi-storied apartments in 30 of four storey each (ground floor, 1st floor, 2ndfloor, 3rd floor and 4th floor). Each floor will have two apartments. In addition the project will have the following auxiliary facilities; nursery school, cybercafé, club house and other sporting facilities. The proposed site is on plot number 13324/1/MN(original no. 9139/1/MN) in Ngomongo villages, Bamburi Location, Shanzu THE KENYA GAZETTE 21st October, 2011 4126 4126 Mombasa County. The proposed project site is approximately 10 kilometres north of Mombasa Island and measures approximately 6.2 hectares. The following are the anticipated impacts and proposed mitigation measures: Environmental issue Mitigation Measures Solid waste disposal All drainage to have covers. Waste bins to be provided at strategic points at all floors and in gardens within the compound. Waste bins to be placed away from drainage. A cold room for handling rapidly decomposing waste such as food left offers to be provided. All waste bins to be emptied daily. All waste bins to have lids on. Occupants of apartments to be sensitised on good waste management practices. Waste Collection Company to ensure there is no littering and scattering of waste during collection and transportation. All waste bins to have lids on always. Temporally cold waste handling facility for rapidly composing waste to be provided. Disposal of sewage from apartments Effective treatment of the sewage to be done before discharge to the environment; Ensure Biological Oxygen Demand (BOD) of the sewage is 30mg/l or less before discharge to environment. – Ensure Carbon Oxygen Demand of the sewage is 50mg/l. or less before discharge to environment. Sludge generated to be first tested for any contaminants before disposal. Local soils to be tested periodically for presence of pollutants emanating from the sewage system. Prompt repair and maintenance of bursts and leakages; Effective aeration of ponds and retention tanks to be done; Micro activity to be enhanced to fasten digestion and breakdown of sewage contents. Ground excavation and removal of vegetation cover Ensure only exact site where buildings will stand to be excavated. Sprinkle water on dusty ground twice a day during dry spell; Provide employees with dust masks; Plant trees on open ground; Encourage vegetation growth on open areas. Health and safety Provide personal protective (PPE) clothing to each employee. Ensure effective use of protective by all employees. Secure loading and offloading zone with dust screens. Noise and vibrations Have noise producing machines be fitted with silencers. Provide employees with ear protectors. Employees to observe silence on site. Construction work to be limited to day time, machine activity to be limited to construction site, noisy machines to be fitted with silencers. Carry out site noise survey. Provide employees with ear protectors. Accidents Fence off and seal site from public access. Employees working at height to be provided with appropriate working gear. Use appropriate elevators and other lifting machinery in conveying building material to high levels. Building to be constructed strictly with specifications of structural Engineer‘s requirements. Constant checking of adherence to required specification and verifications by Government Engineers. Adherence to site specification. Adherence to time and material specifications. Air pollution Use effective dust screens to trap dust. Provide employees with dust masks. Vehicular traffic Develop a traffic marshal plan to regulate traffic in and out of the project site. All drivers delivering and collecting materials in and out of the facility to strictly observe the Highway Code. Speed limits to be strictly observed. Kopex Industries Limited (KIL) management to liaise with the Kenya National Highway Authority for permission to cons truct a deceleration/acceleration lane to aid smooth exit and entry of traffic from the highway into the facility and from the facility into the highway. Adequate internal parking to be provided within the compound. There should be no parking of waiting on the road reserve or the entrance to the plant. Vehicle clearance at the entrance gate to be well coordinated to ensure no pilling up of traffic waiting to enter or exit the proposed project site. Storm water management Rainwater from the roofs to be harvested and stored in underground collected tanks for later use. Appropriate site landscaping to be employed. Vegetation of all open area to reduce surface run off. Cultural erosion and social disruption Code of conduct stating the expected conduct of all residents and their visitors to be developed by Kopex Industries Limited and to be signed upon purchase and/or occupation of the apartments by all apartment owners and all residents. Awareness creation on topical issues among residents such as STD and AIDS, drug and substance abuse . Clearing of vegetation Trees and other vegetation to be cleared only at the exact positions where the buildings will be constructed. All other un-built spaces to be planted with appropriate trees and vegetation. Only 50% of theme Park to be used for the proposed project as intended. The remaining 50% to be vegetated. The project proponent to support tree planting initiatives outside project area to cater for net vegetation loss within the wider project catchment area. Interference with animal habitat within the theme park The two artificial water bodies (at the Elmolo and Luo village) to remain. All trees surrounding artificial water bodies which are habitat of birds to remain intact. The ten large rock outcrops within the Ngomongo theme parks to be preserved. Depleted vegetation habitat to be enriched through planting of new trees and other vegetation. Excavation work and trenching to be limited to exact spots where the buildings will be positioned. Excavated soil and rock material rich in genetic pool to be preserved and later used for in landscaping work. Movement of construction equipment to be limited to construction site to reduce stress on animals. Engineering controls to be employed on construction equipments to reduce noise and excessive vibration that can stress the animals.
