ENVIRONMENT AND LAND CASE 55 OF 2011 DANIEL WAKOLO TIEGO —(PLAINTIFF/APPLICANT) VERSUS GEORGE MUKIZA MUDANYA T/A MUDASA ACADEMY —(DEFENDANT/RESPONDENT ) NOTICE OF MOTION (Under Order 3A and 63(e) of the Civil Procedure Act Cap. 21 Laws of Kenya, Order 6 Rules 1 & 3 (1), (3) and Order 40 Rules 1, 2 &3(1) of the Civil Procedure Rules). 1. THAT the application should be certified urgent and listed for hearing on priority basis for the orders sought. 2. THAT I apply to this court of equity for the suspension of Justice Isaac Lenaola’s Order to be permanently suspended pending the hearing and determination of this suit since it was obtained through conspiracy of my former advocates whom I have since sacked. 3. THAT the temporary order of injunction should be issued against the defendant respondent from entering remaining at home land. 4. THAT I have a prima facie case against the defendant respondent and his agents. 5. THAT this court of equity should compel the defendant respondent and his agents to produce the titles of properties South Maragoli/Buyonga/847/1658. 6. THAT my mother’s bedroom was broken into when the said titles were taken away. 7. THAT the costs of application of the suit should be awarded to the plaintiffapplicant. WHICH APPLICATION is brought on the grounds that: (a) THAT right from December, 2006 I have never entered on my home and it was not part of the conditions of the purported fake lease agreement. (b) THAT whenever I visit home with my family I have been forced to hire lodges. (d) THAT I am responsible for all my actions since am not a kid. (e) THAT through my entrepreneurship intrapreneurship and innovation I am unmasking the monster in the person of the defendant respondent. (f) THAT the remedy is rescission and damages both liquidated and unliquidated because the contract was is fraudulent and deceitful (g) THAT whatever the defendant did to me, my person and my home is civil wrong, criminal offence and deceitful. (h) THAT the court should issue an injunction against the defendant respondent from trespassing using the suit property immediately to stop my suffering.
