GAZETTE NOTICE NO. 14281

Pursuant to Section 348 of the Companies Act, Rules 3, 4 and 9(p) of the Companies (High Court) Rules, Section 67 C of the Insurance Act, Section 3A of the Civil Procedure Act, and Order 37 of the Civil Procedure Rules, 2010) AND UPON READING the Supporting Affidavit of ELIUD MURIITHI sworn on 26th October 2011 and the annextures thereto AND UPON HEARING Counsel for the Plaintiff/Applicant ex-parte; IT IS HEREBY ORDERED: 1. THAT this application be and is hereby certified urgent and heard on priority basis. 2. THAT there be a stay of all proceedings subsisting against Blue Shield Insurance Company Ltd (under Statutory Management) during the currency of the Moratorium declared by the statutory Manager on 16th September 2011. 3. THAT there be a stay of all taxation proceedings currently pending and on-going against Blue Shield Insurance Company Ltd (under Statutory Management) and for which the company may become liable during the currency of the Moratorium declared by the statutory Manager on 16th September 2011. 4. THAT all proceedings of whatever nature of form against Blue Shield Insurance Company Ltd (under Statutory Management) or its policyholders be and are hereby barred during the currency of the moratorium declared by the Statutory Manager. 5. THAT no statutory notices, demands or claims of whatever nature of form shall be effective against Blue Shield Insurance Company (under Statutory Management), its property or its policyholders during the currency of the moratorium. 6. THAT the running time for the purposes of any law of limitation in respect of any notice, demand or claim by any policy holders or creditors of Blue Shield Insurance Company Ltd (under statutory Management) is suspended and shall remain suspended during the currency of the moratorium declared by the Statutory Manager. 7. THAT the applicant be and is hereby given leave to publicize the court’s orders by publishing them in the Kenya Gazette and two local daily newspapers of national circulation.
