GAZETTE NOTICE NO. 14654

Pursuant to regulation 21 of Environmental (Impact Assessment and Audit) regulations, the National Environmental Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the implementation for the proposed construction of sanitary landfill. THE KENYA GAZETTE 25th November, 2011 4512 4512 The project involves the construction of a sanitary landfill in Ruai. The proposed site is located in the East of Nairobi City, adjacent to Dandora Sewerage Ponds on one side by Nairobi River and the Embakasi Ranching Scheme on the other. The project area is located in Ruai Location. The following are the anticipated impacts and proposed mitigation measures: Environmental/Social Issue Management & Mitigation and /or Enhancement Measures General wastes All solid waste will be collected at a central location at each site and will be stored temporarily until removal to an appropriately permitted landfill site in the vicinity of the site. No dumping within the surrounding area is to be permitted. Where potentially hazardous substances are being disposed of, a chain of custody document should be kept with the environmental register as proof of final disposal. Waste generated at the site should be categorised by the contractor and disposed of in a suitable manner into different waste streams (including general and hazardous waste).Wherever possible recycling should be carried out Litter generated by the construction crew must be collected in rubbish bins and disposed of weekly at registered waste disposal sites Waste Water The contractor shall ensure that anywastewater generated during construction of the Sanitary Landfill is properly collected through drains and effectively stabilized No untreated waste water should be allowed to enter the wastewater system or disposed of via the solid waste stream Storm water should be managed in such a way that no overland flow is possible onto the site from any adjacent area Storm water drains in the area should be routinely inspected by the environmental officer for solid waste to avoid blockages and associated problems. Fire prevention and control The Contractor shall take all reasonable and precautionary steps to ensure that uncontrolled fires are not started as a consequence of his activities on site. The Contractor shall ensure that there is basic fire-fighting equipment available on site as per requirement of the local Emergency Services.These include fire blankets and fire extinguishers. The Contractor shall ensure that all site personnel are aware of the fire risks and how to deal with any fires that occur. This shall include, but not be limited to: Regular fire prevention and training sessions and posting of regular instructions to staff and training some of the staff on fire Marshall techniques Any accidental fires, which occur, shall be reported to the CCN DoE Manager immediately and then to the relevant authorities. Erosion Control During Construction any construction materials should be screened or covered to prevent offsite movement (primarily windblown soil) and the surplus material should be removed from site toan approved disposal site. Stripping of vegetation should be minimized to avoid erosion. Dust Control/ air pollution Mitigatory measures such as wetting down, as well as the erection of shade netting screens to prevent offsite movement of dust may also be required. The use of straw stabilisation or mulching ofexposed soil should also be undertaken. Diesel exhaust emissions from heavy machinery on site (excavators, front end loaders and hauling trucks) must be controlled and minimised by regular checks and servicing of vehicles. Construction vehicles emitting excessive smoke should be removed from site All areas disturbed during construction of the sanitary landfill must be re- vegetated Storm water Management and Control Proper drainage channels should be constructed within the construction site. Machinery Management All vehicles, equipments, fuel and petroleum services and tanks must be maintained in good condition to prevent leakage and possible contamination of soil or groundwater Health and Safety The Contractor shall comply with all standard and legally required health and safety regulations under the Occupational Health and Safety Act 2007 and associated regulations. The contractor should provide and maintain personal protective equipment and facilities to employees Official training in the correct fit, use, care, storage and limitations of all Personal Protective Clothing, Respiratory and Hearing Equipment must be given to the employees The Contractor shall provide a standard first aid kit at the site office of each camp and/or at additional identified locations where needed Surface and ground water Machineries should be operated and maintained according to manufacturers guidelines to avoid oil, lubricants and fuel leaks that might pollute water resources in the area Ensure that excavated and stockpiled soil material is stored and bermed on the higher lying areas. Vegetation clearance must be kept to a minimum to reduce the risk of soil erosion Adequate provision must be made for sanitation for the construction workers. Septic tanks on site are to be emptied regularly Noise and Vibrations Construction and the use of construction machinery should be limited between 0600hr and 1800hr on weekdays. 25th November, 2011 THE KENYA GAZETTE The contractor should use modern equipment, which produces the least noise. The use of noise shielding screens should be used and the operation of such machinery restricted to when it is actually required. Construction activities must abide by the national Noise regulations recently gazette by NEMA Prior to blasting (if required), the contractor must inform the adjacent landowners and local administration and obtain relevant permits from Mines and Geology Department Blasting and Drilling (if any) In the event that blasting or rock drilling is required, the following recommendations will be implemented. The contractor shall take all necessary precautions to prevent damage to special features and the general environment, which include minimization of, and if required, removals of any fly rock Environmental damage caused by blasting / drilling shall be repaired at the contractor‘s expense to the satisfaction of the ECO and RE No blasting may be done on Sundays. Careful sealing off of the site and surrounding area will be carried out to ensure that all personnel are removed from the site and its immediate surrounds. Adequate warning must be provided prior to all blasting to all site staff and neighbours. All clear signals must also be clearly given General: Crime, safety and security Ensure that only suitably qualified personnel use construction vehicles Ensure that the contact details of the police or security company and ambulance services are available on site Limit access to the construction crew camp to construction workers through access control Ensure that the handling of equipment and materials is supervised and adequately instructed Vehicular traffic during construction activities must be limited to a maximum speed limit of 30km/hr. Site notices informing the public of the planned activities must be placed at visible locations a few days prior to any blasting Destruction/protection of heritage resource (if any ) Should any archaeological artifacts be exposed during excavation, work on the area where the artifacts were found, shall cease immediately and the ECO shall be notified as soon as possible, the ECO shall then notify the National Museums of Kenya for further action Sensitive environments and natural features within and/or close to a site will be designated as restricted areas and will not be interfered with during decommissioning of the plant Any taxa, especially those of conservation concern (as per the ecological report) exposed during the closure of the site should be captured for later release or translocation to adjacent suitable habitat Aesthetic/ visual Prevent unnecessary removal of vegetation outside the width of the working area by clearly demarcating the working are Remove spoil material from the area once the trench has been filled Revegetate disturbed ground in the working area by seeding and spreading of vegetation that has been removed from the trench at the start of construction Demobilisation The site is to be cleared of all construction materials, including litter prior to hand over Fences, barriers and demarcations associated with the construction phase must be removed from the site The site must be fully rehabilitated and stabilized (for example, through re- vegetation) A meeting must be held on site between the Engineer, ECO and the Contractor to approve all remediation activities and ensure that the site has been restored to a condition approved by the Engineer Rehabilitation Activities of Environmental Cases indentified must continue throughout the defect liability period The full report of the proposed project is available for inspection during working hours at: (a) Director General, NEMA, Popo Road, off Mombasa Road, P.O.
