THE LAND REGISTRATION ACT

REGISTRATION

WHEREAS Mutyauvyu Mbatha (deceased), is registered as proprietor of that piece of land containing 2.534 hectares or thereabout, situate in the district of Machakos, known as Athiriver/Athiriver Block 5/297, and whereas the High Court of Kenya at Machakos in Succession Cause No. 48 of 2014, has issued a grant of letters of administration to (1) Raphael Mbatha Daniel (ID/4893901) and (2) John Bosco Musyoka Mutyauvyu (ID/12533306), and whereas the said (1) Raphael Mbatha Daniel (ID/4893901) and (2) John Bosco Musyoka Mutyauvyu (ID/12533306) have executed L.R.A. 39 for registration, and whereas all efforts made to recover the land title deed for said piece of land have failed, notice is given that after the expiration of thirty (30) days from the date hereof, I intend to dispense with the production of the said land title deed and proceed with registration of L.R.A. 39 to (1) Raphael Mbatha Daniel (ID/4893901) and (2) John Bosco Musyoka Mutyauvyu (ID/12533306), and upon such registration the land title deed issued earlier to Mutyauvyu Mbatha (deceased), shall be deemed to be cancelled and of no effect.
