APPOINTMENT
IT IS notified for the general information of the public that the
Cabinet Secretary for Tourism and Wildlife has appointed the
Advisory Committee on the Transfer of the Amboseli National Park to advise on the framework for the transfer of function of the Amboseli
National Park (ANP) to the County Government of Kajiado. The
Advisory Committee shall comprise of the following members:

1. The Terms of Reference of the Advisory Committee are to:
(a) Look into the relevant legal and policy frameworks governing the transfer of the Amboseli National Park (ANP) from the
National Government to the County Government of Kajiado, recommend any legislative amendments required for the seamless transfer and prepare the draft amendments where necessary;
(b) Develop a legal and institutional framework for the coordinated transfer of function of the Amboseli National Park (ANP) to the County Government of Kajiado in a manner that ensures continued service delivery, full legal and regulatory compliance;
(c) Ensure that the transfer of functions framework observes and promotes all national, regional and international obligations relating to environmental and biodiversity conservation;
(d) Develop guidelines and operational mechanisms to be applied during the transition period for audit, verification and the transfer of functions of the Amboseli National Park (ANP) to the County Government of Kajiado;
(e) Provide advice on how to handle the status of the assets, liabilities and the attendant resources required to run the
Amboseli National Park (ANP);
(f) Obtain all the necessary reports and documents necessary for implementing the transfer process;
(g) Develop a programme for pre, during and post-handover protocols, including the development of rules of engagement during the three phases of the transfer process;
(h) Propose a framework for the governance, institutional and organizational structure of the transitioned park;
(i) Oversight the management and operations of the Amboseli
National Park (ANP) as it transitions to the County
Government of Kajiado;
(j) Continuously manage the transitional process and update on the progress and take remedial actions where and when necessary to stem any impending challenges for intergovernmental action;
(k) Advise on the financial and human resource impacts of the transfer process on the National Government and County
Government of Kajiado;
(l) Develop an indicative budget and roadmap for each phase of the handover processes identified;
(m) Consider, perform, or advise on any other matter or subject ancillary to the above; and
(n) Perform any other duties related to the assignment as may be prescribed by the Cabinet Secretary.
2. In the discharge of its functions, the Transition Advisory
Committee shall have power to-
(a) Regulate its own procedure;
(b) Be responsible to the Cabinet Secretary for Tourism and
Wildlife;
(c) Hold meetings or consultations as it shall deem necessary in such places and at such times as the Committee shall consider necessary for the proper discharge of its mandate;
(d) Review official reports, policy, legislation or any other document related to the Committee mandate;
(e) Carry out or cause to be carried out such assessments, studies or research as may inform its mandate;
(f) Co-opt experts, in particular areas of need as may be necessary for the execution of its mandate;
(g) Hold consultations with stakeholders to solicit, receive, consider and collate inputs that may be useful for the performance of its mandate; and
(h) Create sub-committees for the efficient and expedited discharge of its mandate;
3. The terms of the Committee shall be for a period of six (6) months with effect from the date hereof, or for such a period as may be specified by notice in the Kenya Gazette.
4. The Cabinet Secretary shall constitute a Secretariat that will include a Head of Secretariat, and other relevant technical experts. The
Secretariat shall be domiciled at the Ministry of Tourism and Wildlife offices and shall be responsible for:
(a) Providing appropriate background briefing to the Transition
Advisory Committee;
(b) Preparing the reports of the Transition Advisory Committee and disseminating any information deemed relevant, and;
(c) Liaising with the relevant Government departments and any other institution or stakeholders in order to gather relevant information necessary for informing the Transition Advisory
Committee.
