GAZETTE NOTICE NO. 4467

PURSUANT to section 59 of the Environmental Management and Co-ordination Act, 1999, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above-proposed project. The proponent, Kenya Ports Authority intends to relocate over 1648 households to pave way for the implementation of the proposed Mombasa Special Economic Zone project. The targeted resettlement area land will be subdivided into 1/3 and 1/8 an acre parcels. The resettlement plan will include land surveying, land adjudication, construction of about 33km on resettlement area access roads, installation of water supply infrastructure(pipeline from borehole and construction of water access point),construction of solid waste management points, installation of additional public utilities(ECD Centers), places of worship and health centers, installation of 320kv powerlines for connections to all occupied plots, construction of model market structure, associated facilities and amenities. The project affected persons will be relocated from Dongo Kundu to Mbuta location Likoni Sub-county, Mombasa County. The following are the anticipated impacts and proposed mitigation measures: Environmental Impacts Mitigation Measures Loss of biodiversity • Kenya Ports Authority to issue guidelines for site layout and conservation immediately plot allocation is finalized. • Kenya Ports Authority will deploy scouts to control local sourcing of building wood and soil resources. • Kenya Ports Authority to lobby Kenya Forest Service to gazette all Kayas into Forest Reserves under the Forests Act of 2013. • Kenya Ports Authority will undertake fencing and reforestation in Kaya Miongani, Ngombeni and Mwanakuku with combined area of 8.5ha. • In-situ mapping of endangered flora on allocated plots for preservation. Increased traffic • Install adequate safety features including speed control bumps and warning signage. • Prompt handover of completed roads to the County Government of Mombasa for Management. • Residents to mount an aggressive road safety programme. • Full implementation of the Traffic Management Plan (TMP) prepared during the Traffic Impact Assessment (TIA). • Ferry building materials and construction waste during the off-peak hours. Generation of solid and liquid waste. • Design and implement a Waste Management Plan for the entire project cycle. • Prompt handover of completed Market to the County Government of Mombasa for Management. • Provide sufficient and suitable sanitary conveniences for the construction workers. THE KENYA GAZETTE 12th April, 2024 Environmental Impacts Mitigation Measures • Mobilize conservation groups to undertake recovery, recycling and composting of market waste applying the 3Rs principle. • Deployment of professional staff who will operate the medical facility to ensure safe segregation and disposal of waste as per already established practice. • Storage of waste in leak proof facilities. • Manage the waste in line with the Environmental Management and Co- ordination (Waste Management) Regulations, 2006 and Sustainable Waste Management Act, 2022. • Engage a NEMA-registered waste transporter to collect and dispose of segregated waste to designated disposal sites. Occupational safety and health and fire hazards • Contractors site to be registered as a Place of Work under the Occupational Safety and Health Act, 2007. • Provide adequate barriers, information, signage and reflective tapes at all construction area and material site. • Deploy sober qualified staff under competent supervision. • Provide adequate and appropriate Personal Protective Equipment’s (PPEs) for staff estimated. • Mount an aggressive safety campaign. • Contractor to deploy only serviceable plant and equipment. • Plant Operators to work only for stipulated hours daily. • Contractor to implement approved Fire Control Plan. Proliferation of social vices including spread of HIV and AIDS • KPA to mount aggressive counselling and outreach Programme through MCG. • Review the construction activities to integrate with the HIV/AIDS campaigns. • Develop appropriate training and awareness materials for Information, Education and communication (IEC) on HIV/AIDS. • Identify other players (local CBOs, NGOs, and government organizations) to assist in the dissemination of the awareness of HIV/AIDS for enhanced collaboration. • Develop an intervention strategy compatible with the construction programme to address success of the HIV/AIDS prevention and provide peer educators for sustainability in collaboration with other stakeholders; and • Integrate monitoring of HIV/AIDS preventive activities as part of the construction supervision. Basic knowledge, attitude and practices are among the parameters to be monitored, and particularly on provision of condoms, status testing and use of ARVs. Conflict in labour sourcing • Implementation of the Livelihood Restoration Programme including skills upgrading training as per CPF. • Priority job placement in the Special Economic Zone for Project Affected Persons. Environmental Impacts Mitigation Measures • Kenya Ports Authority to grant Project Affected Persons continued access to non- utilized Special Economic Zone land under lease agreements. • Negotiated job placement to ensure: (i) Employing the locals; (ii) Gender equity and equality; and (iii) Consideration for people living with disabilities. Increased energy demand • Kenya Ports Authority to mount a Programme to promote alternative sources of Household energy. • Kenya Ports Authority to promote energy efficient technologies. • Kenya Ports Authority to promote aggressive afforestation under the proposed adopt a road reserve Programme. • Kenya Ports Authority to mount aggressive surveillance conservation programme for reserve areas. Air pollution • Screen the entire site to control and arrest construction-related dust. • Monitor the air quality levels as per the Environmental Management and Co- ordination (Air Quality) Regulations, 2014. • Contractor to ensure scheduled maintenance of plant and equipment so as to control fumes. • Proposed soil dump for the roads contractor to undergo independent Summary Project Report.
