GAZETTE NOTICE NO. 6440

PURSUANT to section 59 of the Environmental Management and Co-ordination Act, 1999, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Mysha Investment Limited proposes to construct 34 No. blocks of residential apartments each comprising of 6No. floors with a total of 816 No. residential units (144 No. one bedroom units, 336 No. two bedroom units and 336 No. three bedroom units) 2No. waste water treatment plants, swimming pool, parking spaces, retail shops, sports pitch, associated facilities and amenities, on plot L.R. No. MN/II/257 in Kisauni, Mombasa County. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Solid waste management • Installation of waste segregation bins in each of the 34 blocks to collect waste from the housing units. • Contract NEMA registered waste contractors to handle waste from housing development. • Encourage residents to segregate waste at source to improve material recovery from waste fractions. Traffic disruption • Warning signs to be placed to advise pedestrians and manage their safety when walking internal roads in the housing development. • Implement traffic management plan developed for the project. • The timing of the truck arrivals and departures should largely be outside of the commuter peak periods. • During the construction stages, all trucks are to enter the construction site and not occupy the nearby roads with a traffic control plan. • Warning signs are to be placed to advise pedestrians and manage their safety when walking across the construction driveways. • All material handling is to be done within the site boundaries. Sewage and waste water • Routine inspection, maintenance of the sewer treatment plants. • Disposal of sludge per Hazardous waste regulations. • Reuse of waste water in landscaping. Noise and vibration pollution • Schedule noisy activities during the normal working hours of between 8 a.m. to 5 p.m. • No work should be undertaken at night or very early in the morning. • Switch off idle machines and equipment. • Ensure machinery is well serviced to reduce the noise emitted. • The contractor should adhere to the provision in the Environmental Management and Co-ordination (Noise and Excessive Vibration Pollution) (Control) Regulations, 2009. • Provide workers with appropriate PPEs when working in noisy environments example ear plugs. THE KENYA GAZETTE 24th May, 2024 • Construction waste is not to enter the biophysical or socio-economic environment and Contractors to have waste management plans to mitigate potential impacts. Air pollution • Practice dust management techniques, including watering and spraying to suppress dust. • Move earth and sand in covered vehicles/transport to avoid it being blown by wind increasing suspended particulate matter in the atmosphere. • All power plants are to be of good condition with acceptable smoke emissions. • Set up dust barriers/screens at strategic locations; and Provide and enforce the use of Personal Protective Equipment (PPE) for staff. Water shortages • The contractor should sensitize construction workers on the importance of proper water management through clerks of works by having talks with them when doing their rounds around the site. • Replace or repair leaking pipes supplying water to the construction sites to minimize wastage. • The Contractor should ensure the provision of adequate water storage facilities on the construction site to meet project needs during periods of high demand externally and refill storage tanks during periods of low demand. Pollution/contamination of ground surface water • Appropriate containment structures are to be provided to store contaminated water from the construction site. • The concrete batching area should be bounded to prevent contamination of soils and surface water features. • All fuel storage to be appropriately bunded and provided with a canopy. • Ablutions for construction workers to enable proper disposal of faecal matter and avoid contamination of surface water features which could be a cause of waterborne diseases. Occupational health and safety • The contractor should ensure registration of all construction works by the Directorate of Occupational Safety and Health services (DOSH) in compliance with the Buildings and Works of Construction Engineering Rules. • The contractor should contract a qualified Health and Safety advisor to conduct training and monitoring of construction works. • The contractor should provide a standard First Aid Kit on site. • The Contractor should train several workers in First Aid depending on the number of workers on site.
