Whereas, Article 179 (4) of the Constitution also states that, the county governor and the deputy county governor are the chief executive and deputy chief executive of the county, respectively. Whereas Article 201 (d) and (e) of the Constitution states that public money shall be used in a prudent and responsible way and that fiscal reporting shall be clear. Whereas the Report of the Kajiado County Assembly Adhoc Committee on the consideration of a Petition on removal from office of the Governor Joseph ole Lenku by Musa Tipape Naini has proposed specific recommendations in line with Petition to County Assemblies (Procedure) Act, No. 15 of 2020. 9th August, 2024 THE KENYA GAZETTE Whereas the Report of the Kajiado County Assembly Adhoc Committee on the consideration of a Petition on removal from office of the County Executive Committee Member, Mr. Alais Kisota by Musa Tipape Naini has proposed specific recommendations in line with Petition to County Assemblies (Procedure) Act, No. 15 of 2020. Whereas, section 30 (2) (e) of the County Governments Act, 2012, read together with section 35 and 36 confers power to constitute the county executive committee portfolio structure to respond to the functions and competencies assigned to and transferred to each county. Determination, restructuring and organization of the county and its various departments is conferred on the Executive Committee under section 46 (1). Now, therefore, by the Authority vested in me as Governor by the Constitution of Kenya, 2010 and the County Governments Act, 2012, I Joseph ole Lenku, Governor of Kajiado County do hereby order and direct as follows: (i) THAT the County Executive committee to immediately deliberate and commission an external technical committee/taskforce that will look at the allegations of imprest management by the county executive and the allegations on statutory deductions. The County Secretary to furnish the final report upon my office and to the Kajiado County assembly committee of finance within 3 months. (ii) THAT on the County Revenue Management I direct the department of finance to implement the following; • County Revenue Management System to be fully automated. Through automation, we expect heightened accuracy and efficiency, achieved by methodically sealing potential loopholes, minimizing remittance delays, and proactively preventing revenue loss in every step of the collection process. • Facilitate proper and reliable ICT network and power infrastructure of the revenue collection system. • Establish a Revenue Steering Committee that comprises of all Chief Officers and County Executive Committee (CEC) Members. The Committee should oversee all revenue automation functions at the County. Through regular meetings, duplications of financial management systems and associated projects can be identified and action taken. • A change management team should be established that comprises all sections that are affected with any system setups. Change agents should be at all levels in sections who will also act as trainer of trainees at the appropriate module. • Implement a training programme focused on enhancing the capacity of revenue collection staff. This will enhance the skills of their revenue staff, supervisors, county assemblies, management, and policy makers. • County Human Resource Advisory Committees need to review compensation packages of staff working in the revenue sections. This, in turn, leads to increased productivity and improved performance of revenue sections within counties. • Engage all sectors, stakeholders, and revenue payers when formulating revenue-raising measures and laws. This inclusive process would incorporate diverse perspectives and safeguard the interests of stakeholders. This intervention will address challenges such as irregular collections and unscrupulous practices. The revenue team to also pursue comprehensive revenue-generating opportunities that are untapped. • Establish internal controls such as independent process checks, regular review of audit reports, and evaluation of revenue collection. These measures are vital for ensuring ongoing enhancements in revenue collection, including through maintaining readily available databases, ideally harmonized across counties using standardized automated data management systems. (iii) THAT the County Secretary and the Department of Finance and Economic Planning to immediately develop and implement an organogram for the revenue department showing clear reporting lines and submit it to my office and to the Kajiado County Assembly Committee of Finance within two (2) months. (iv) THAT the County internal audit to investigate the alleged loss of own source revenue and recommend administrative action where necessary. (v) THAT the department of roads and public works to undertake to complete the pending public works mentioned in the report. Dated the 7th March, 2024.
