THE CONSTITUTION

AMENDMENT


WHEREAS, Article 179 (1) of the Constitution provides that, the executive authority of the county is vested in, and exercised by, a County Executive Committee. Section (2) of the same article argues that the County Executive Committee consists of— (a) the county governor and the deputy county governor; and (b) members appointed by the county governor, with the approval of the assembly, from among persons who are not members of the assembly. WHEREAS, Article 179 (4) of the constitution also states that, the county governor and the deputy county governor are the chief executive and deputy chief executive of the county, respectively. WHEREAS, section 30 (2) (e) of the County Governments Act 2012, read together with sections 35 and 36 confers power to constitute the county executive committee portfolio structure to respond to the functions and competencies assigned to and transferred to each county. Determination, restructuring and organization of the county and its various departments is conferred on the Executive Committee under section 46 (1). According to this section, I as the Governor can determine the number and nature of departments at the decentralized units; abolish any department; and determine or change the name of any department. WHEREAS section 45 (5) of the County Governments Act also provides the Governor may re-assign county chief officers. WHEREAS section 46 (1) (2) (d) of the County Government Act ensures that the county departments align their roles and responsibilities with the priorities and objectives set out in the county’s policies and County executive committee to determine organization of county COMMITTED to enhancing coordination, efficiency, transparency and accountability in all functions of the County Government through a governance structure and leadership that ensures rapid delivery of public services to the people of Kajiado County in every part of the County; and CONSCIOUS that a review and reorganization of my administration is necessary to ensure operational enhancements and functional changes that shall make departments to deliver on their mandates. Now, Therefore, by the Authority vested on me as Governor by the Constitution of Kenya and County Governments Act, I, Joseph Jama ole Lenku; Governor of the County Government of Kajiado do hereby order and direct as follows; (i) THAT the County Government of Kajiado shall be reorganized as set out in this Executive Order; (ii) THAT the County Public Service Board as a matter of urgency recruits 3 directors to boost revenue forecasting and collection. (iii) THAT I have with immediate effect, in accordance with section 15 and 18 of the County Governments (Amendment) Act, 2020 constituted a selection panel to recruit a new THE KENYA GAZETTE 9th August, 2024 County Secretary and Member of the Kajiado County Public Service Board. (iv) THAT the department of Water, Environment, Climate Change and Natural Resources to immediately initiate a restructuring of all County water companies to ensure equitable access of clean water to all Kajiado residents. (v) THAT the portfolio responsibilities and changes made in the structure of County Government set out in this order shall come into immediate effect; and (vi) THAT the Executive Orders No. 1 of 2018, No. 2 of 2019, No. 3 of 2020 and No. 4 of 2021 and Executive Order No. 3 of 2023 are hereby further amended accordingly.
