MR18808077 GAZETI-ENOT]CENO. 1846 THE ENVIRONMENTAL MANAGEMENT AND CO-ORDINATION ACT (No. 8 of 1999) THE NATIONAL ENVIRONMENT MANAGEMENT AUTHORITY ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORT FOR THE PROPOSED REHABILITATION OF ISEBANIA- MUKUYU—AHERO (Al) ROAD IN MIGORI,KISII, HOMA BAY AND KISUMU COUNTIES INVITATION OF PUBLIC COMMENTS PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project. The proponent, Kenya National Highways Authority, is proposing a Rehabilitation of Isebania—Mukuyu—Ahero (Al) Road, in Migori, Kisii, Homa Bay and Kisumu counties. The project will involve rehabilitation of an existing 167 kilometers (km) Road from Ahero through Kish to Isebania. The proposed road traverses four counties namely: Migori, Kisii, Homa Bay and Kisumu and touches the peripheries of Kericho and Nyamira counties, It starts at Ahero junction on BI road then moves southerly via Katito, Onyuongo, and Nyabondo to Sondu to Oyugis where it meets C26. From Oyugis, it moves via Morocho and Nyamataro meeting the B3 road within Kisii town. From here, it changes direction via Suneka, Kamagambo, Rongo, Awendo, Uriri, and Kakrao near Mukuyu, Migori, and Isebania and terminates at the border at Nyabikaye. The Mukuyu- Kisii—Ahero section is a 149 km long single carriageway. Its average width is 4.5m and varying shoulder of 0.5-1.5m wide, built to bituminous standard in 1969. It now has exceeded its design life of 20- 25 years. The rest of the stretch, about 18 km long from Mukuyu to Isebania had been improved-to 7m wide carriageway with 1-1.5m wide shoulders is in better condition but scheduled for the rehabilitation. - The following are the anticipated impacts and proposed mitigation measures: Identified Impacts Proposed Mitigation Climate Change Proposed designs provide for concrete culverts and ensure that the detailed drainage designs accommodates the projected Climate Change predictions. Spçcial care to be taken when construction is taking place near sensitive receptors such as schools and hospitals. • The location and operation of asphalt batch plants to be sited far from sensitive receptors, such as shopping centers, health facilities and learning institutions • To the extent possible, heavy vehicles should not be used at night across populated areas especially in towns and settlement areas. - • Ensure that construction equipment is operating optimally and with operational noise mufflers. Provide solid and liquid waste disposal system - a waste collector, NEMA recommended waste disposal manual and a waste collection bin for each housing unit, workshop, plant, structural shelter. • Acquire all the relevant licenses prior to drilling boreholes through an abstraction permit from the Water Resources Management Authority (WRMA), and a license from NEMA. • Explore possibility of sourcing construction water from other sources and not groundwater, given the high number of permanent rivers in the project area. • Carefully select any permanent water sources, to be handed to the communities upon decommissioning. • The Contractor should consult the community on suitable location for sinking the boreholes. • Provide solid waste disposal system - a waste collector, NEMA recommended waste disposal manual and a waste collection bin for each housing unit, workshop, plant, structural shelter, etc. • Waste disposal site to have stone perimeter wall; 1.5 in high x 7 in long x 5 in wide at a far corner to contain disposed materials from wind and run- off. • Keep records of all disposal/ potential disposal locations. • Hazardous materials to be stored within dedicated areas at work camps and yards in full compliance with regulatory requirements and the contractor to ensure that all waste materials at the point of construction are transported to a place of safe disposal. • Areas dedicated for hazardous material storage to provide spill containment and facilitate -clean up through measures such as: clear identification of the materials present; access restricted to authorized personnel and vehicles only and dedicated spill response equipment • Avoid spillage. • Carry out remediation immediately. • Empty containers to be managed carefully to avoid exposing life to • possible poisoning. •. Replant with original vegetation at the completion of the construction phase • Construction activities will be localized to specific site thus minimizing vegetation loss. • Keep land clearance to a minimum and wherever possible avoid clearing areas of highly erodible soils and steep slopes which are prone to erosion. • Avoid the cutting down of trees as much as can be avoided. • Constantly monitor bridge locations for new ecosystems/habitat development. • Ensure that provision that has been made in the design for bridges, culverts, cut-off drains and side drains to improve drainage is adhered to. Relocation impact . Identify and Consult project affected persons and compensate them as per the • - laid down policies. • Consult the Project Affected Persons (PAP's) on, and offer choices among technically and economically feasible resettlement alternatives. • Land acquisition to be done before the contractor goes to site. • Compensate those affected according to the laid down policies in collaboration with the Ministry of Lands. • Implement an institutional structure or a mechanism for monitoring and evaluating the compensation/ resettlement process. Road safety To reduce accidents, appropriate road signs and road markings to be put in place to warn drivers of safety hazards especially while approaching bends, junctions, bridges, animal crossings, schools and shopping centres. • To reduce the possibility of vehicle and animals collisions vehicle speeds shall not exceed posted speed limits and animal crossing warning signs shall be installed where appropriate. • Training of boda boda riders on traffic regulations. • Keep surveillance on roadside markets who encroach on the roads and interrupt visibility.
