THE ENERGY ACT

(No. 12 of 2006)

AMENDMENT

PURSUANT to the provisions of sections 5, 6 and 25 of the Energy Act, 2006 and provisions of Legal Notice No. 24 of 2012, The Petroleum (Amendment) Rules 2012, the Energy Regulatory Commission notifies the general public that it has received an application from Oil Marketing Companies (OMCs) for yield shift compensation, a claim arising from the processing agreement between OMCs and Kenya Petroleum Refineries Limited (KPRL). The Energy Regulatory Commission has decided as follows: - (a) That the arrangement between OMCs and KPRL was of a contractual nature between the parties to the Processing Agreement and the commercial dispute should be settled within the terms of the said Agreement. (b) That yield shift losses cannot be recovered as pass-through cost under the Legal Notice No. 24 of 2012, The Petroleum (Amendment) Rules 2012. • The decision is based on the objects and mandate of the Energy Regulatory Commission provided under sections 5 (b) of the Energy Act Dated the 19th April, 2016.
