"Assembly" mcans thc County Assembly of Wajir or a Committee of the County Assembly; "Authorized Offrcer" mcans the Speaker of the County Assembly or his designate "Bank Account" has thc mcaning assigned to it under section 2 of the Act; "Codc" mcans the kadership and Integrity Code for'State Officers in the County Asscmbly of wajir;' "Commission" means the Ethics and Anti-Comrption Commission cstablished under section 3 of the Ethics and Anti-comrption commission Act, No. 22 of 2}ll; "Office" means the County Assembly or a Committee of the County Assembly; "Perconal Interest" means a matter in which a State Officer has a dircct or indirect pecuniary or non-pecuniary intercst and includes the intercst of this or her spouse, child, business associate or agent; "Public Offrccr" has thc meaning assigned !o it under Article 260 of the Constitution; "Regulations" means the Regulations madc by ihe Ethics and Anti- Comtption commission pursuant to section 54 of the Act; "Serving State Officer" means a State Officer who is in offrce at the time of commencement of this Code; "Statc Offiier" means a Member of the County Assembly of Wajir; Application of Chapter Six of the Constitution, the kadership and Intcgrity Act, 2012 and the Public Oficer Ethics Act, 2003; a. (l) The provisions of Chapter Six of the Constitution, the kadership and Inrcgrity Act, the Public Officer Ethics Act 2003 and shall form part of the code. Commitmcnt to the Codc 5. (l) A Statc Officcr elected to thc County Assembly shall sign and commit to this Code at the time of taking oath of office or within scvcn days of assuming office. (2) A serving Stale Officer shall sign and commit to this Code within scven days of the publication of the Code in the Gazette. (3) Thc declaration of commitment to the Code shall take the form and structurc sct out in the First Schcdulc to this Code. PART III _ REQI.JIREMENTS Rule oJLaw 6. (1) A State Offrcer shalt respcct and abide by the Constitution and all othcr laws. (2) A Stata Officer shall carry out the duties of his or her offrce in accordance with thc law. (3) In carrying out the duties of his or hcr office, a State Officer shall not violate the rights and fundamental frccdoms of any person. Public trust 7. A Statc Office is a position of public trust an{ the authoriry and responsibility vestcd in a State Officer shall be excrcised by the State Officcr in the best intcrest of the ofFrce and the people of Kenya. Responsibility and dutie s 8. Subject !o the constitution and any other law, a State Officer shall takc pcrsonal responsibility for the reasonably foreseeable consequenccs of any actions or omissions arising from the discharge of the duties of his or her office. Performance of duties 9. A State Officer shall, o the best of his or her ability - (a) carry out the dutics ofthe office efficiently and honestly; (b) carry out the duties of thc office in a transparent and accountablc mann€r; (c) keep accurate rccords and documents relating to the functions of the office; and (d) report truthfully on all matters of the office. Professionalism 10. A Statc Offrcer shall- (a) carry out the duties of his or her off,rce in a manner that maintains public confidence in the intcgrity of the offrce; (b) fieat members of the public, staff and other state and public officers with court€sy and respect; (c) a the extent appropriate to thc ofFrcc, maintain high standards of performance and level of profcssionalism within thc officc; and (d) if the Starc Offrcer is a-member of a professional body, observe and subscribe to the ethical and professional requircmcnts of that body in so far as thc requirements do not contravcne the Constitution, any other law or this Code. Confidentiality 11. A State Officer shall subject to Article 35 of the Constitution and any other relevant law, a State Officer shall not disclose or cause to be disclosed any information in his or her custody to any unauthorized pcrson. Financial integriry 12. (l) A Statc Officer shall not use his or her officc to unlawfully or wrongfully enrich himself or herself or any other person. (2) Subject to articlc '16(2) (b) of the Constitution a State Officer shall not accept a personal loan or benefit which may compromise the State Officer in carrying out his or her duties. (3) A State Officer shall submit an initial dcclaration of income, assets and liabilities within thirty days of assuming offrce and thereafter make biennial declarations !o the officc, and a final declaration within (30) days of ceasing to be a Stale Officcr. (4) The Declaration under sub-paragraph (3) shall be submittcd to the County Assembly Service Board. (5) A declaration filed by a State Offrccr in accordancc with the provisions of sub-paragraptr (:) straU be accessible to the Commission and any othcr pcrson, subject !o the provisions of Scction 30 of the Public Ofhcer Ethics Act, 2003. (6) A State.Officcr shall pay any taxes, loans or othcr debts due from him within the prcscribed period. (7) A State Offlrcer shall not neglect their financial, family or othet legal obligations. Moral and ethical requirements 13. (l) A Statc Officer shall observe and maintain the following ethical and moral rcquircments- (a,) dcmonstrate honesty in the conduct of his or her public and private affairs; (0) not to engage in activities that amount !o abusc of office; (c) accurately and honesty tcpresent information to the public; (d) not engage in wrongful conduct in furtherance of personal bcnefrt; (e) not misuse public resources; (fl not falsify any records; (g) not scxually harass or have inappropriatc sexual relations with other State Officers, staff of thc offrcc or any othcr pcrson; (h) not engage in actions which would lead !o thc State Officcrs removal from the mcmbership of a profcssional body in accordance with thc law; (y' not commit offences and in particular, any of the offcnces under parts XV ahd XVI of dtc Penal Code, Sexual offences , act,2006, the Counter-Trafficking in Persons Act, 20O8, and the Children Act; f) not engage in fighting or physical confronlation with any Person; (/<) Maintain high standards of etiquctte at all times. ' (2) A person who wishes !o bc elccted the Office shall for thc purposes of this Code, submit to the Independent Electoral and Boundaries Commission a self-declaration in the form sct out in the First Schedule to the Act. Gifis or benefits in kind 14. (1) A gift or donation given to a State Officcr on a public or offrcial occasion shall be treated as a gift of donation to thc office. (2) Notwithstanding subparagraph (l) a Statc Officer may reccive a gift given to the Statc Officer in offrcial capacity, provided that- )l i .; g 22nd luly,2016 THE KENYA GAZETTE 2869 i i (a) the gifl is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and within tlrc ordinary standards of hospitality ; - (b) thc gift is not monctary; (c) thc gtft docs not cxceed the value of Kcnya Shillings twenry thousand or such othcr amount as may be prcscribcd by tlrc Commission through Regulations. (3) A State Officcr shall not- (a) accept or solicit gifts, hospitality or other bencfits from a pcrson who- (i) has an intercst in any matt€r under consideration by thc Assembly; (ii) has a contractual rclationship with the offrce; (iii)has any intercst that is dircctly or indircctly connected with thc State Officcrs duties. (b) rcceivc a gift which has thc potential of compromising his or her inrcgrity, objectiviry or impartidiry; ot (c) acccpt any type of gift cxprcssly prohibitcd under thc Act; (4) A Statc Officer who rcceivcs a gift or donation shall declare the gift or donation to the Authorized Officcr within scvcn days of reccipt of thc gift. (5) Thc OfFrcc shall maintain a rcgistEr of all gifts rcccived by thc state Officcrs scrving in thc Officc and anothcr registcr of all gifu given by the ofFrce to othcr State or Public Officcts. Wrongful or unlawful acquisition of property 15. A Statc Officer shall not usc the office !o wrongfirlly or unlawfully acquirc or influcncc thc acquisition of public or othcr propcrty. Conflict ol intercst 16. (l) A Statc Ofirccr shall usc the best efforts o avoid being in a conflict of intcrcst a situation whcrc his or hcr pcrsonal intcrcsts conflict or appcar to conflict with the State OfFrcers official dutics. (2) Without limiting thc gcncrality of subparagraph (1) a Statc Officer shall not hold sharcs or havc any othcr inrcrest in a corporation, partncrship or othcr body, directly or.through mothcr person, if holding thosc shares or having that intcrcst would result in a conflict ofthc Statc Officcrs and thc ofFrcers offrcial duties. (3) A State Officcr whosc pcrsonal intcr€st's conflict with thcir official dutics shall declare thc personal intercst to thc office. (4) Thc Offrce may givc dfupctions on thc appropriate action to the takcn by drc Statc Officer to avoid the conflict of intcrcst and trc Statc Offrccr shall comply widr thc dircctions, and refrain from participating in any dcliberetions with rcspcct to thc mattcr. (5) Any direction issucd by the office under sub paragraph (4) shall bc in writing. (6) Notwithstanding any directions !o thc contrary undcr subparagraph (4) a State Officer shall not influcncc the award of a contract to- (a) himsclf or hcrsclf; (b) the State Officcrs spouse or child; (c) a busincss associate or agent; or (d) a corporation, private company, partnership or other body in which thc officer has a substantial or controlling intcrcst. (7) Whcrc a State Offlrccr is prescnt at a mccting, and an issuc which is likcly to result in a conflict of intercst is to bc discusscd, thc Statc Officcr shall dcclarc the interest at the beginning of the meeting or bcfore thc issuc is deliberated upon. (8) A dcclaration of a conflict of int€rcst under subparagraph (7) shell be rccordcd in the minutes of that meeting. (9) The Ofhce shall maintain a register of conflicts of intcrcst in the prcscribcd form in which an affcctcd State Officer shall rcgistcr thc particulars of the rcgisfable intcrcsts, stating the naure and extcnt of thc conflict. (10) For purposes of subparagraph (9), the rcgistrablc intcrcsts shall include- (a) thc interests sct out in the second schcdule of thc AcU (D.) any connection with a pcrson, firm or a company, whether by relation, fricndship, holding of shares or othc.-rwisc, which is subject of an invcstigation by tlre Constitution; (c) any application for employment or other form of engagement with the office by a family mcmbcr or friend of the State Officer or by a law firm or corporation associated with thc Starc Officer; (d) any application !o the office, by a family member or friend of thc Stat€ Offrcer, for clearance with respcct to appointment or election to any public offrce; (e) any other matter which, in the opinion of the State Officer, taking into account the circumstances thereof, is necessary for registration as a conflict of in$erest. (11) Thc Office shall kcep thc register of conflicts of interest for five ycars after the last cntry in each volume of thc register. (12) The Office shall prepare a report of thc registered interests within thiry days aftcr thc close of a financial year. (13) A State Officcr shall ensure that an entry of registrable intcrcsts undcr subparagraph (9) is updated and to notify the officc of any changes in thc registable interests, within one month of each changc occurring. Participation in tenders invited by the ofice 17. (l) A State Officcr shall ndt participate in a tcnder for the supply of goods or serviccs !o the ofEce. (2) Notlithstanding subparagraph (l) a company or entity associatcd with the State Offrcer shall not be construcd as trading with the officc, unless- (a) the State Offrcer has a controlling shareholding in the company or cntity; (r) thc State Otricer is a dirpctor of the company; (c) thc Sate Offrcer is a managing partrcr in a law firm providing scrvices to the office. Public Collections 18. (l) A State Officer shall not solicit foi contributions from the officc or any other pemon or, public entiry for a public purpose untess thc Presidcnt'has, by notice in the Gazctte, declared a national disaster and allowcd a public collcction for the purpose of the national disaster in accordance with the law. (2) A Statc Officer shall not participate in a public collcction of funds in a way that rcflects adverscly on the Statc Offrcen' integrity, impar,tiality or interferes with the Performancc of the offrcial duties. (3) Nothing in this clause shall be constructed as prohibiting a Statc Officcr from making voluntary contribution. Bank accounts outside Kentn 19. (l) Subjcet to Articlc 76(2) of the Constitution or any other writtcn law, a State Officer shall not open or continue to operate a bank account outside Kenya without the approval of thc Commission. (2) A State Officer who has reasonable grounds for opening or operating a bank account outside Kcnya shall apply to the commission for approval to open or opcntc a bmk account outside Kenya. (3) A Statc Offrccr who operates or controls the opcration of a bank account outsidc Kcnya shall submit statEments of thc account annually !o the commission and authorize the commission to verify the statcmcnts and any othcr relevant information from the foreign financial instiution in which the account is held. (4) SubFct to subparagraph (l) and (2), a pcrson who is appointed as a Statc Officer in thc officc and has a bank account outside Kenya shall, upon such appointsncnt close the bank account within 3 months or such othcr period as thc Commission may prescribc by notice in the Gaz*tE (5) Subject to subparagraph (4) a Statc Off,rccr may open or continuc to opcratc a bank account ourcide Kcnya as may be authorized by the Commission in writing. Acting Jor Joreigners 20. (1) A Statc Officer shall not be an agcnt of, or further the intcrcsts of a forcign govcrnment, organization or individual in a mangcr that may bc dctrimental to the securiry intercst! of Kenya, cxccpt when acting in the course of ofhcial duty. In this codc, unlcss thc contcxtothcrwisc rcquircs- "Act" mcans thc Lce&nhip rnd Incgrity Act, ?sl2; [No. 19 of 20121; "Accounting Offrccr" mcenr trp Clcrt of thc Coxrty Assanbly; "Assembly" means the County Assembly of Kiambu or a Commlttec of the County Assembly; "Authorized Offrcer" means the Speaker of the County Assembly or his designate; "Bank Account" has the meaning assigned to it under section 2 of the Act; "iode" means the Leadership and Integrity Code for Starc OfFrccrs in the County Assembly of Kiambu; "Commission" means the Ethics and Anti-Comrption Commission established under section 3 of the Ethics and Anti-comrption commission Act, No. 22 of 20ll; "Office" means the County Assembly or a Committee of the County Assembly; "Pcrsonal Intcrest" means a matter in which a State Officcr has a direct or indirect pecuniary or non-pecuniary interest and includes the interest of this or her spouse, child, business associate or agent; "Public Office/' has the meaning assigned to it under Articlc 260 of the Conqtitution; "Regulations" rheans the Regulations made by the Ethics and Anti- Comrption commission pursuant to section 54 of the Act; "Serving State Offrccr" means a State OfEcer who is in office at the time of commencement of this Code; "State Offrccr" mcans a Member of thc C-ounty Assembly of Kiambu. Application of Chapter Six of the Constitution, the lzadership and Integrity Act,2012 and the Public Oficer Ethics Act, 2AOi 4. (1) The provisions of Chapter Six of the Constitution, thc kadership and Integrity Act, the Public Officcr Ethics Act 2003 and shall form part of the code. Commitment to the Code 5. (l) A Starc Offrcer clccted to die County Assembly shall sign and commit to this Code at the time of taking oath of office or within seven days of assuming offrce. (2) Serving State Offrccrs shall sign and commit to this Codc within Fourteen (14) days of the publication in the Gazette. (3) The declaration of commitment to the Code shall take thc form and structure set out in the First Schedulc to this Codc. PART II_REQI]IREMENTS Rule of Law 6. (1) A State Officer shall rcspect and abide by the Constitution and all other laws. (2) A State Officer shall carry out the duties of his or her office in accordance with the law. (3) In carrying out thc duties of his or her off,rce, a State Offrcer shall not violate the rights and firndamental freedoms of any person. Public trust 7. A State Office is a position of public trust and the authority and responsibility vested in a State Officer shall bc exercised by thc Statc Officer in the best interest of the offrce and-the people of Kenya. Re sp o nsib ility and d.l tie s 8. Subjcct to the constitution uri *y other law, a State Officer shall takc penonal responsibility for the rcasonably foreseeable consequences of any actions or omissions arising from the discharge of the duties of his or hcr offrce. Performance ofduties 9. A State Officer shall, to the best of his or her ability- (a) carry out the duties of the office efficiently and honestly; (U carry out the duties of the office in a transparent and accountable manner; (c) keep accurate records and documents relating to the functions of the offrce; and (d) Report truthfully on all matters of the offrce. ProJessionalism 10. A State Officer shall- (a) cary out the duties of his or her office in a manncr that maintains public confidence in the int€grity of thc office (b) wat mcmbers of the public, staff and other state and public offrcers with courtesy and respect; (c) !o the extent apprqriatc to the offrce, maintain high standards of performancc and lbvel of professionalism within the office; and (d) tf tbe Starc Offrccr is a member of a professional body, obscrve and subscribe to the ethical and profcssional requirements of ' that body in so far asthe requirements do not conEavenc the Constitution, any other law or this Code. Confidentiality I l. A State Officer shall subjcct to Article 35 of the Constitution and any othcr relevant law, a Statc Officcr shall not disclosc or causc to bc disclosed any information in his or hcr custody to afly unauthorized pcrson. Financial integrity 12. (l) A Statc Officer shall nof use his or her office to unlawfully or wrongfully enrich himself or herseH or any other pcnton. . (2) Subject to articlc 76(2) b) of the Constitution e Statc OfEcer shall not accqrt a personal loan or bcnefit which may compromi3c the Statc Officcr in carrying out his or her dutics. (3) a Statc Officer shall submit an initial declaration of income, assets and liabilities within thirty days of assuming office and thereafter make biennial declarations to thc officc, and a final declaration within (30) days of ceasing to bc a State Officcr. (4) The Dectaration undcr sub-paragraph (3) shall be submittcd to the CoUnty Public Service Board. (5) A declaration filed by a State Officer in accordance with the provisions of sub-paragraph (3) shall be accessible to thc Commission and any other person, subjcct to thc provisions of Section 30 of the Public Officer Ethics Act, 2003. (6) A State Officer shall pay ar5r taxes, loans or other debts drre from him within the prescribcd period. (7) A State Officer shall not ncglcct their financial, family or other legal obligations. _ Moral and ethical requirenwnts 13. (2) Notwittrstanding subperegraph (l) a Stetc OfEcer mry rcccive a gift givcn to the Statc Officer in offrcial capaciry, providcd that- I I I I I ,l I i I r I l i F. rt e 22nd July,2O16 THE KENYA GAZE'rIE 2873 (o) the gift is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and within the ordinary standards of hospitality ; (D) the gift is not monetary; (c) the gift does not exceed the value of Kenya Shillings twenty thousand or such other amount as may be prescribed by the Commission through Rcgulations; (3) A State Officer shall not- (a) Accept or solicit gifts, hospitality or other benefits from a person who- (i) has an interest in any matter under consideration by the Assembly; (i0 has a contactual relationship with the office; (iii) has any interest that is directly or indirectly connected with the State Off,rcers duties; (iv) receive a gift which has the potential of compromising his or her inrcgrity, objectiviry or impartiality; or (v) accept any type of gift cxprcssly prohibitcd under the Act. (4) A State Officer who receives a gift or donation shall dcclare the gift or do_nation to the Authorized Officer within sevcn days of receipt ofthe gift. (5) The OfEce shall maintain a register of all gifts received by the state Officers serving in the Offrce and another register of all gifts given by the office to other State or Public Offrcers. Wrongful or unlawful acquisition of ptoperty 15. A State Officer shall not use the office to wrongfully or unlawfully acquire or influence the acquisition of public or other property. Conflict of interest 16. (l) A State Officer shall use the best efforts to avoid being in a conflictof interesta situation where his or her personal intercsts conflict or appear to conflict with the State Officers official duties. (2) Without limiting the generality of subparagraph (1) a State Officer shall not hold shares or have any other interest in a colporation, partnership or other body, directly or through another person, if holding those sharcs or having that interest would rcsult in a conflict of thc State Officers and the officers official duties. (3) A State Offrcer whose personal interest's conflict with their official duties shall declare the pcrsonal interest to the office. (4) The Office may give directions on the appropriate action to the taken by the State Offrcer to avoid the conflict of interest and the State Officcr shall comply with the directions, and refrain from participating in any deliberations with respect to lhe matter. (5) Any direction issued by the offrce under sub paragraph (4) shall be in writing. (6) Notwithstanding any directions subparagraph (4) a State Officer shall not contract to- (a.) himself.or herseH; (D) the State Officers spouse or child; (c) a business associate or agent; or to the contrary under influence the award of a (d,) a corporation, private comPany, partnership or other body in which the officer has a substantial or controlling interest. (7) Where a State Officer is present at a meeting, and an issue which is likely to result in a conflict of intcrcst is to be discussed, the Statc Officer shall declare the interest at the beginning of the meeting or bcfore the issue is deliberated upon. (8) A declaration of a conflict of interest under subparagraph (7) shall be recorded in the minutes of that meeting. (9) The Offrce shall maintain a registcr of conflicts of interest in the prescribed form in which an affected State OfFrcershall register the particulars of the rcgistrable interests, stating the nau.rre and extent of the conflict. (10) For purposes of subparagraph (9), the rcgistrable interests shall include-- (a) the interests set out in the second schedule of the Act; (b) any connection with a person, firm or a company, whether by relation, friendship, lrolding of shares or otherwise, which is subjcct of an invcstigation by the Constitution. (c) any application for employment or other form ofengagement with tlre office by a family member or friend of the State Officer or by a law firm or corporation associated with the State Officer. (d) any application to the officc, by a family member or friend of the State Officer, for clearance with respcct to appointrnent or election to any public offrce. (a) any other matter which, in the opinion of the State Off,rcer, taking into account the circumstances thereof, is necessary for registration as a conflict of interest. (11) The OfFrce shall keep the rcgister of conflicts of interest for fivc years after the last entry in each volume of the registcr. (12) The Office shall prcpue a report of the registered interests within thirty days after the close of a financial year. (13) A State Officcr shall ensur€ that an entry of rcgistrable inrcrests under subparagraph (9) is updated and b notifu the office of any changes in thc registrablc interests, within'one month of each change occurring. Participation in tenders invited by the ofice 17. (1) A State Officcr shall not participate in,a tender for the supply of goods or sen,ices !o the office. (2) Notwithstanding subparagraph (l) a company or entity associated with the State Off,icer shall not be construed as trading with the office, unless- (a) the State Offrcer has a controlling shareholding in the company or entity; or . (b) tlrc State Officer is a director of thc company; or (c,) thc State Officer is a managing parnrer in a law frm providing services to the office. Public Collections 18. (l) A State Officer shall not solicit for contributions from the office or any other person or, public cntity for a public purpose unless the Presidcnt has, by notice in the Gazefte, declared a national disaster and allowed a public collection for the purpose of the national disaster in accordance with the law. (2) A State Officer shall not participate in a public collection of funds in a way that reflects adversely on the State Offrcers' integrity, impartiality or interferes with the Performance of thc official duties. (3) Nothing in this clause shalt Ue constructed as prohibiting a State Officer from making voluntary contribution. Bank accounts outside Kenya 19. (1) Subjcct to Article 76(2) ot the Constitution or any othcr written law, a State Officer shall not open or continue to operatc a bank account ouside Kenyp without thc apprcval of the Commission. (2) A State Offrcer who has reasonable grounds for opcning or operating a bank account outside Kenya shall apply to the commission for approval to open or operate a bank account outside Kenya. (3) A State Offrcer who operatcs or controls the operation of a bank account outside Kenya shall submit statements of the account annually to the commission and authorize the commission to verify thc statements and any other rclevant informati,on from the foreign financial institution in which the account is hcld. (4) Subject to subparagraph (1) and (2), a pcrson who is appoinrcd as a State Officer in thc office and has a bank account outside Kcnya shall, upon such appointment closc the bank account within 3 months or such other period as the Commission may prescribe by notice in the Gazette. (5) Subject to subparagraph (4) a Statc Gfficer may opcn or continue to operate a bank account outside Kenya as may be authorized by the Commission in writing. Acting Jor loreigners 20. (1) A Starc Offrcer shall not be an agent of, or firrther the intercsts of a forcign government, organization or individual in a manger that may bc detrimental to the sccurity interests of Kenya, except whcn ecting in thc course of official duty. (2) For dre purposes of this paragraph- (a) rn tndividual is a forcigncr if thc individual is not a citizcn of Kcnyd; and (b) n oryaniz*ion is forcign if it is cstlblished outsidc Kcnya or is owned or contnollcd by a forcign governmcnt, organization or individual. (3) Where a Breach of this code amounts to violation of the Constitution, the State Officer may be removed from the office in accordance with the applicable laws. (4) Where an allegation of breach is made to the Offrce, the person alleging the breach shall submit a petition setting out the ground.: and facts of the alleged violation to the Authorized Officer of the Office. (5) Upon receipt of the Complaint, the Off,rce shall register and carry out investigations into the complaint, and may take action against the State Officer in accordance with the Act, Standing Orders of the Assembly, any Regulations made by the Commission under the Act or other law that for the time being governs the conduct of State Officers in the Assembly. (6) If upon investigation into the alleged breach of the Codc, the Office is of the opinion that civil or criminal proceedings out to be prefcrred against the respectivc State Officer, it shall rcfcr the mattcr to- (a) the Commission, with respect to civil mattcrs; and (b) the director of Public Prosecutions with respect to crimins.l mattcrE.
