The following are the anticipated impacts and proposed mitigation measures: Impact Mitigation Measures Soil and geology • The minimum area required for disturbance construction shall be cleared of vegetation. •Top soil shall not be disturbed more than it is absolutely necessary but not below the first impermeable layer. •A minimum amount of storm water will be allowed to flow on the site and control measures like paving and banding to avoid storm water damage. •Denuded areas shall be landscaped and vegetation re-planted as soon as feasible after construction. Loss of vegetation cover • Re-vegetation to control potential soil loss. •Prevention of soil contamination through oil spills/leaks from construction machinery. •Landscape area with similar vegetations. •Preservation of excavated top-soil for future site restoration procedures particularly in highly disturbed areas. •Limiting vehicular transport to defined roads as to prevent unnecessary injury to vegetation and habitat destruction. •Implementing good housekeeping practices on site and implementing a Solid Waste Management plan in order to eliminate any source of hazard to the native fauna. •Ensure proper demarcation and delineation of the project area to be affected by construction works. •Utilize appropriately clearing techniques (e.g. hand clearing as opposed to mechanized clearing) by using human labour as opposed to heavy machinery. •Minimize clearing and distribution to riparian vegetation. Biodiversity loss • Generally, the following should be considered during construction. •Design with a view to incorporating nature conservation into the development including appropriate friendly boundary fencing. •Retain existing habitats where possible and aim to keep natural site features in context rather than in isolated fragments. Pay attention to field boundaries and hedgerows and preserve wildlife corridors and habitat links. Consider integrating ecological features, for example climbing plants and bird nest boxes, within any buildings or structures. •Routine checking of trenches (if any) and escape routes to minimize, if not prevent, entrapment of fauna. •Reporting of any violation relating to hunting and trading activities. •Minimizing the removal off-site of any soils containing invasive species. •Compliance with the ecological requirements of the project and any other legal requirements with regard to waste management, environmental pollution, discharge to waters among others. •Replacement of lost habitat throughout the site or in other areas, where possible. •Ensure that landscape design reflects local ecology and uses locally sourced plants wherever possible. Native trees and shrubs should be used for landscaping where practical. Soil erosion • Any construction materials should be screened or covered to prevent off-site movement and the surplus materials should be removed from the site to an approved disposal site. •Striping of vegetation should be limited to areas where civil works will be undertaken. •Beaming of the open trenches should be undertaken to prevent them from being washed away by runoff . •Sensitization of workers on environmental protection. •Soils excavated from the tower pad area shall be used for backfilling. •Soils shall not be left exposed to wind /water for long. Solid waste management • Clearing of bushes/vegetation, excavation and cutting should be restricted within the project area. •All solid wastes should be collected at central location for temporary storage until removal to an appropriate disposal site. •Waste generated at the site should be sorted by the contractor and disposed of in a suitable manner into different waste streams. •As provided for by the Building Code, a temporary latrine will be provided on site to be used by construction workers. •Receptacles will be provided for waste storage prior to collection. •Resource recovery will be encouraged once the project takes off so as to shrink waste stream and recover non- recyclables. •Refuse collection vehicles will be covered to prevent scatter of wastes by wind. •Wastes will be collected by a licensed operator to avoid illegal final dumping at unauthorized sites. NO. 5740 / 15 & 5740 / 17 AT NATTIRI, AT LUNGAI VILLAGE, ALONG SIKHENDU - NAITIRI ROAD IN BUNGOMA COUNTY INVITATION OF PUBLIC COMMENTS PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessnient Study Report for the above proposed project. The proponent, West Kenya Sugar Company Limited is proposing to expand its operations by putting up a 2500 TCD (Ton Sugar Cane crushed per day) sugar factory for the purposes of processing sugar cane and producing milled sugar and other related by-products on Plot L.R Nos. 5740/15 and 5740/17 in Lungai Village at Naitiri, Tongues Sub-county in Bungoma County. The expected production capacity for the proposed sugar factory will be around 78,000 tons of brown and mill white sugar. molasses and bagasse by-product. The project will comprise of the cane yard section, mill house, process house, boiler house, spray pond, bagasse holding facility, distillery, bagasse co- production, water treatment facility, parking and administration section, workshop and firefighting section. The following are the anticipated impacts and proposed mitigation measures: Impacts Mitigation Measures Site disturbance • Avoiding the disturbance of areas not within the site for the WESKCOL sugar factory. •Designing and implementing an appropriate landscaping programme to help in vegetating a good part of the area in WESKCOL sugar factory. •Using of appropriate methods for intercepting and slowing water runoff within the construction site. Dust and gaseous • Exposed soils and other erodible emissions materials should be re-vegetated or covered promptly in order to minimize dust emissions. New areas should be cleared and opened-up only when absolutely necessary. Any bare surfaces should be re-vegetated otherwise rendered non-dust forming when inactive. •Loading, transfer and discharge of construction materials should take place with minimum height of fall and be shielded against the wind and consider the use of dust suppression spray systems. •There will be no open burning of construction and/or waste materials at the site. •There will be no excessive idling of construction vehicles in the sites •Construction vehicles and other equipment shall be properly serviced Noise and vibration • Ensuring that noise levels at the nearest sensitive receptor should meet them MICA (Noise and vibration Control Regulations, 2009) •There will be no unnecessary hooting by construction vehicles at the construction site. •Where it is necessary noise emissions should be controlled and minimized through the application of appropriate measures which may include: •Implementation of =closest and cladding of noisy sections, •Installation of proper sound bafflers and/or noise cmtaimmts, with enclosures or curtains at the equipment e.g. crashers, grinders and screens Solid waste • Use of an integrated solid waste management system through a hierarchy of the following options: a) source induction, b) material recycl=g, c) composting and reuse, d) combustion and e) sanitary land filling. •Dispose wane more responsibly by dumping at designated dumping sites or landflls only. •Use building materials that have minimal or no packaging to avoid the generation of excessive packaging waste. •Provide waste collection bias at designated points within the processing plant •Engage NEMA registered waste disposal company for transportation and disposal of solid waste from site. Influx of construction • WESKCOL in partnership with the workers local administration and religious institutions will undertake a skills audit could be undertaken and a register compiled of persons who have skills that could be used by the project. •The WESKCOL recruitment policy should be well communicated to the general public in advance. Health and safety • All personnel should be trained on health and safety procedures and how to respond in case of accidents. All construction workers in the WESKCOL sugar factory should be trained on how to handle unexpected events such as accidents, fires or explosions, chemical spins, floods, power failures and authquakes. To adequately prepare for emergency, all personnel should plea. train, and practice emergency responses. Staff should also be encouraged to prepare for emergencies inside their workplace. As a standard procedure on health and safety, appropriate guidelines and signage shall be put up in prominent places for the attention of all workers. •All personnel should be trained to use of fire extinguishers. The types of fire extinguishers should be supplied based on the types of combustible and flammable materials in the processing plant. •Preparation of emergency response plans specifically applicable to exploration and production activities (considering the geographically isolated nature of mining sites) and including the provision and maintenance of necessary emergency response and rescue equipment. •Encourage the use of preventive measures like condoms. •Avail condom dispensers to the staff and workers. •Strengthen advocacy through awareness training in HIV/AIDS and other STDs. •Provide counseling and testing for HIV/AIDS to all the employees. •WESKCOL will ensure that appropriate washing and screening of all incoming construction machineries originating from other locations in order to avoid the transfer of dangerous invasive species through soil and biological material attachments on construction equipment. •Wherever possible, containment of water collected from areas with potential contaminants will be ensured. Such waste water should be reused. •Oil interceptors and sediment traps should be installed and maintained to ensure any discharge to the environment carries a low sediment load. •Storm water management canals and dams should be maintained and kept clean in order to ensure that the capacity of such systems is not compromised during the life of the operations. •Sensitization of the clients who buy molasses of the environmental effects of the product so as to prevent spillage of the same. •Sensitization of farmers to protect wetlands and other fragile ecosystems including riparian buffer zones as natural filters of farm-based nutrient leakage into streams and rivers.
