GAZET-I'E NOTICE NO. 6756 KITUI COUNTY COUNTY FRAMEWORK FOR THE IMPLEMENTATION OF THE KITUI COUNTY PRO-POOR SUPPORT PROGRAMME ESTABLISHMENT IT IS notified for the general information of the public that pursuant to the Constitution of Kenya, 2010, Article 174 (d) and (f) 14th July, 2017 THE KENYA GAZETTE 4207 that recognizes the objects of devolution as "to recognize the right of communities to manage their own affairs and to further their development" and "to promote social and economic development and the provision of proximate, easily accessible services throughout Kenya" respectively and Article 43 (1) (j) which identifies the fundamental economic and social right of education as a right for every person, the County Government of Kitui established the Pro- Poor Support Programme as one of its flagship initiatives to ensure increased schools retention rate and ultimately enhance education performance in the County. The Programme is aimed at increasing the rate of access, transition and retention of learners from financially disadvantaged backgrounds and improving the education sector by supporting the provision of teaching and learning materials, equipment and facilities. It shall be domiciled in the Office of the Governor of Kitui County. The Governor of the County Government of Kitui has pursuant to section 30 (2)(i) of the County Governments Act assigned the implementation of the Pro-Poor Support Programme to the County Executive Committee Member for the County Ministry of Basic Education, Training and Skills Development. In implementing the programme, the County Executive Committee Member shall use the following framework and procedure. 1. The programme is to be community based for the purpose of ensuring that the propective benefits are available to a widespread cross-section of the inhabitants of a particular ward or village. PRO POOR SUPPORT PROGRAMME MANAGEMENT COMMITTEE 2. There is established a management committee to be known as the Pro-Poor Support Programme Management Committee. 3. The Pro-Poor Support Programme Management Committee shall consist of— a Chairperson of the Management Committee, who shall be the County Executive Committee Member for County Ministry of Basic Educations Training and Skills Development; and the County Secretary; the Chief Officer in the County Ministry of Basic Education, Training and Skills Development, who shall be the Secretary; the Chief Officer in the County Ministfy of Finance and Economic Planning; and the Chief Officer in the County Ministry of Administration and Co-ordination of County Affairs. 4. The Management Committee shall r considered properly constituted with a quorum of at least three of its members. 5. The functions of the Pro-Poor Programme Management Committee shall be to— receive and review programme implementation and expenditure reports for the programme; ensure maintenance of proper records and reports for the programme; set and review the criteria and conditions governing the granting of fee support; receive and review the list of beneficiaries and award fee support; and ensure prudent management of the programme's funds; 6. The Executive Committee Member County Ministry of Basic Education, Training and Skills Development shall convene meetings of the Management Committee. INFRASTRUCTURE PROJECTS 7. Projects undertaken under this programme shall be selected through a needs assessment to be carried out by the County Ministry of Basic Education, Training and Skills Development to determine education based projects needed most in various parts of Kitui County. 8. Projects may include costs related to studies, planning and design or other technical input for the project. 9. Projects that are eligible to be implemented under this programme may include, but are not limited to— Construction of Early Childhood Development Education (ECDE) Classrooms; or construction of village polytechnics, home craft centres and child centres supply of outdoor play equipment to pre-primary schools; supply of library books and other teaching and learning materials and equipment; supply of mattresses and beds; (ñ supply and installation of Water tanks; construction of pit latrines; power connectivity, electrical wiring and accessories; fencing works; construction of secondary and primary school classrooms; construction of school science laboratories, dormitories and dining facilities; and (1) supply and installation of school laboratory equipment. 10. Proposed projects for this programme shall be tabled before the Management Committee for final decision making on projects to be financed. 11. The Chief Officer in the County Ministry for Basic Education, Training and Skills Development shall coordinate the relevant technical department in preparation of the bill of quantities for all projects approved for funding by the Management Committee. 12. Projects under this programme shall be implemented with the assistance of the relevant county government departments. 13. The Governor or his appointee shall launch, commission and handover the project to the users. 14. The Chief Officer in the County Ministry for Basic Education, Training and Skills development shall ensure that all complete projects are operationalized. FEE SUPPORT SELECTION PROCESS 15. (1) The Village Administrator shall hold public barazas at the village level where the public shall identify students from economically disadvantaged backgrounds. (2) Following 15 (1) above, the Village Administrator shall prepare a list of the proposed beneficiaries for handing over to the Ward Administrator. 16. The Ward Administrator shall chair a meeting of Village Administrators to compile a list of selected fee support beneficiaries from all villages in the respective wards for onward transmission to the Sub-County Administrator. 18. The Sub-County Administrator shall receive the lists of compiled selected fee support beneficiaries and forward them to the Secretary of the Management Committee. 19. (1) While selecting applicants to benefit from the program, the community shall be guided by the following criteria: Priority shall be given to orphans and students from economically disadvantaged backgrounds. Priority shall be given to students who have not yet received support from other organizations, institutions or bodies. The potential beneficiary must be enrolled in a learning institution or have secured a place therein. Each beneficiary shall only benefit from one tranche per financial year. (2) Subject to the existing circumstances, the community shall take into consideration the one third gender rule when selecting students to benefit from the fee support. 20. The Management Committee shall ensure that cheques issued for fee support are written in the name of the school or learning institution and submitted together with an attached list of beneficiaries. FUNDS 21, (1) The funds available for the programme shall consist of monies appropriated for the programme by the County Assembly through the annual budgetary process. (2) The funds referred to in (1) above shall be applied as follows— seventy percent (70%) shall be used amongst the forty wards to cater for fee support and teaching and learning materials; twenty five percent (25%) shall be utilized to cater for infrastructural projects; and five percent (5%) shall be utilized to defray the programme's administration costs. 22. Utilization of programme funds shall be governed by the Public Finance Management Act (2012), the Public Procurement and Disposal Act (2015) and any other laws and regulations governing public finance.
