WHEREAS Kilungu Mwinzi Nziu, of P.O. Box 2158-90100, Machakos in the Republic of Kenya, is registered as proprietor of that piece of land known as Kinyatta/Ikombe "B"1803, situate in the district of Machakos, and whereas the senior resident magistrate's court at Kithimani in succession cause No. 48 of 2016, has ordered that the said piece of land be transferred to (1) Peter Kilungu Mwinzi and (2) Ndivo Kilungu, both of P.O. Box 2158-90100, Machakos in the Republic of Kenya, and whereas the magistrate of the magistrate's court has in pursuance to an order of the said court executed the grant and confirmation of the said piece of land in favour of (1) Peter Kilungu Mwinzi and (2) Ndivo Kilungu, both P.O. Box 2158-90100, Machakos in the Republic of Kenya, and whereas all efforts made to compel the registered proprietor to surrender the land title deed issued in respect of the said piece of land to the land registrar have failed, notice is given that after the expiration of thirty (30) days from the date hereof, provide no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with registration of the said instruments of transfer and issue a land title deed to the said (1) Peter Kilungu Mwinzi and (2) Ndivo Kilungu, and upon such registration the land title deed issued earlier to the said Kilungu Mwizi Nziu, shall be deemed to be cancelled and of no effect. Mlolongo in the Republic of Kenya, is registered as proprietor of that piece of land known as Mavoko Town Block 2/15202 and 15203, situate in the district of Machakos, and whereas the judge of the High Court at Machakos in succession cause No. 233 of 2015, has ordered that the said piece of land be transferred to (1) Rael Ngina Ngila and (2) Ezekiel Kiilu Mutua, both of P.O. Box 185, Mlolongo in the Republic of Kenya, and whereas the judge of the High Court has in pursuance to an order of the said court executed the grant and confirmation of the said piece of land in favour of the above named Charles Ngila Nzuki, of P.O.
